Overview

The Telecommunications Technical Standard (Requirements for Customer Equipment, operating in the voiceband, for connection to the non-switched Telecommunications Network – AS/ACIF S006) 2001, enacted under the Telecommunications Act 1997, was introduced to address the need for consistent technical standards governing customer equipment used for voiceband services on non-switched telecommunications networks. This technical standard was established to safeguard the integrity of telecommunications networks and facilities, protect the health and safety of individuals who interact with these networks, and ensure that customer equipment used in such contexts can access emergency call services. It also aims to maintain interoperability between customer equipment and telecommunications networks when used in standard telephone services. The enactment of this standard by the relevant authority under subsection 376(1) of the Telecommunications Act 1997 reflects the policy objective of ensuring safe, reliable, and interoperable telecommunications services.

Scope and Application

The Telecommunications Technical Standard (Requirements for Customer Equipment, operating in the voiceband, for connection to the non-switched Telecommunications Network – AS/ACIF S006) 2001, as amended, is made under the Telecommunications Act 1997 and applies to all customer equipment designed or intended for connection to a non-switched telecommunications network and for operation in the voice frequency band, provided it does not possess DC or out-of-band signalling capability or a DC power feed. This technical standard is designed to safeguard the integrity of telecommunications networks, ensure the health and safety of individuals who interact with telecommunications networks or equipment, and facilitate the use of customer equipment to access emergency call services. The legislation also mandates that customer equipment, if used to supply a standard telephone service, must be interoperable with the telecommunications network. The application of this standard is limited to equipment that meets the specified criteria, and it incorporates the Australian Standard/Australian Communications Industry Forum Standard (AS/ACIF S006:2001). Any amendments to the AS/ACIF Standard after the commencement of this technical standard will only affect the terms of this technical standard if such amendments are formally adopted by the relevant authority.

Key Provisions

The Telecommunications Technical Standard (Requirements for Customer Equipment, operating in the voiceband, for connection to the non-switched Telecommunications Network — AS/ACIF S006) 2001, as amended, sets out the technical requirements for customer equipment designed for connection to a non-switched telecommunications network and operating in the voice frequency band. This includes equipment such as modems, fax machines, and other communication devices that are not connected to a public switched telephone network. The standard applies specifically to equipment that does not have DC or out-of-band signalling capabilities or DC power feed (Section 6). Entities and individuals involved in the design, manufacture, sale, or use of such customer equipment must ensure that their products comply with the Australian Standard/Australian Communications Industry Forum Standard (AS/ACIF S006:2001). This compliance ensures that the equipment is safe, reliable, and capable of accessing emergency call services when connected to a non-switched telecommunications network. Moreover, if the equipment is used in the supply of a standard telephone service, it must be interoperable with the telecommunications network to which it is connected (Section 7). Failure to comply with this technical standard can result in significant legal consequences. Firstly, any entity or individual found to be in breach of the technical standard could face enforcement actions under the Telecommunications Act 1997. The penalties for non-compliance can include substantial fines, with the exact amount determined by the court based on the severity and impact of the breach. Additionally, persistent or severe breaches may lead to criminal charges, resulting in further penalties such as imprisonment. Ensuring adherence to the standard is therefore crucial to avoid these severe repercussions.
