Overview
The Telecommunications Act 1997 was enacted by the Parliament of Australia to provide a comprehensive regulatory framework for the telecommunications industry, ensuring fair competition, innovation, and efficient use of the spectrum. One of the issues the Act aimed to address was the need for consistent technical standards to facilitate the interconnection and interoperability of telecommunications equipment, including analogue video customer equipment connected to telecommunications networks. The Act empowers the Australian Communications Authority (ACA) to develop and enforce technical standards to maintain the quality and reliability of telecommunications services.
In line with the policy objective to standardise technical requirements for analogue video customer equipment, the ACA established the technical standard ACA TS 015 – 1997. This standard, approved by the ACA on 10 December 1997, specifies the technical conditions and performance requirements for analogue video customer equipment connected to a telecommunications network. The enactment of this technical standard ensures that such equipment complies with the necessary technical specifications, thereby contributing to the overall quality and reliability of telecommunications services provided to consumers.
Scope and Application
The Telecommunications Technical Standard (General Requirements for Analogue Video Customer Equipment Connected to a Telecommunications Network—ACA TS 015 – 1997) applies to all entities involved in the design, manufacture, and sale of analogue video customer equipment that connects to a telecommunications network in Australia. This encompasses a broad range of industries and stakeholders, including telecommunications service providers, manufacturers, and consumers. The geographic scope of this Act is national, as it pertains to the Commonwealth of Australia, ensuring consistent standards are upheld across the entire country. This technical standard is established under the authority of the Telecommunications Act 1997, which governs telecommunications in Australia, and the standard itself is subject to any modifications or updates that may be issued by the Australian Communications Authority. The standard specifies technical conditions and performance requirements that must be met by analogue video customer equipment, ensuring interoperability and quality of service on telecommunications networks. The Act does not explicitly state any exclusions or exemptions, but it does rely on subordinate instruments to further define and extend its application.
Key Provisions
The Telecommunications Technical Standard (General Requirements for Analogue Video Customer Equipment Connected to a Telecommunications Network—ACA TS 015 – 1997) establishes the technical conditions and performance requirements for analogue video customer equipment that connects to a telecommunications network. This standard is made under subsection 376(1) of the Telecommunications Act 1997 (the Act) and was approved by the Australian Communications Authority (ACA) on 10 December 1997. The document is referred to as ACA TS 015 – 1997 and it was gazetted on the same date it was approved.
The obligations imposed by this technical standard primarily affect manufacturers and suppliers of analogue video customer equipment. These entities must ensure that their products meet the specified technical conditions and performance requirements outlined in ACA TS 015 – 1997. This includes adherence to criteria that govern the interoperability, reliability, and safety of the equipment when connected to a telecommunications network. The standard ensures that the equipment will function effectively without causing undue interference to the network or other devices connected to it.
Any failure to comply with the requirements of ACA TS 015 – 1997 can lead to civil and criminal consequences. Under the Act, non-compliance can result in penalties imposed by the ACA. Specifically, under section 376(4) of the Act, the ACA can impose a civil penalty for breaches of technical standards, with the maximum penalty being up to $22,200 for corporations and $4,440 for individuals. Additionally, the Act provides for criminal penalties for serious or repeated breaches, which can include fines and imprisonment. The exact penalties will depend on the nature and severity of the breach, as well as any previous history of non-compliance.
