Overview

The Telecommunications Numbering Plan Number Declaration Amendment Declaration 2004 (No. 1) was enacted by the Australian Communications Authority under the Telecommunications Numbering Plan 1997. This legislative instrument addresses the need to update the allocation of premium rate numbers for telecommunications services, ensuring that these numbers are available for various services that require higher call charges, such as directory enquiries or premium-rate services. The Declaration commenced on the date of its notification in the Gazette and amends the Telecommunications Numbering Plan Number Declaration 2000 to reflect the updated ranges of premium rate numbers available for allocation. The policy objective is to maintain an efficient and flexible numbering plan that supports the evolving needs of the telecommunications industry and consumers.

Scope and Application

The Telecommunications Numbering Plan Number Declaration Amendment Declaration 2004 (No. 1) is a legislative instrument made by the Australian Communications Authority under the authority conferred by subsection 3.39(1) of the Telecommunications Numbering Plan 1997. This amendment applies to the allocation of premium rate numbers within Australia, affecting telecommunications service providers and consumers who use these services. The Declaration provides specific ranges of six-digit and eight-digit premium rate numbers that are available for allocation, as detailed in Schedule 2. These numbers are available for assignment in accordance with the procedures outlined in Part 5 of Chapter 3 of the Telecommunications Numbering Plan 1997. The Declaration came into effect on the date of its notification in the Gazette, ensuring that the amendments to the Telecommunications Numbering Plan Number Declaration 2000 are immediately applicable. There are no stated exclusions or exemptions within this Declaration, and its reach is confined to the specified ranges of premium rate numbers within the Australian telecommunications numbering plan.

Key Provisions

The main operative sections of this legislation are sections 2 and 5. Section 2 states that the Declaration commences on the date of its notification in the Gazette, while Section 5 outlines the availability of certain premium rate numbers for allocation. Specifically, Section 5(1) stipulates that premium rate numbers are available for allocation in accordance with Part 5 of Chapter 3 of the Telecommunications Numbering Plan 1997, and Section 5(2) lists the specific ranges of premium rate numbers that are available for allocation, detailed in Schedule 2. The obligations and requirements imposed by this Act on the parties or entities it governs include the allocation of premium rate numbers in accordance with the Telecommunications Numbering Plan 1997. These obligations are detailed in Section 5, which mandates that premium rate numbers are available for allocation and specifies the particular ranges of numbers that are available, as listed in Schedule 2. The Australian Communications Authority (ACA) is responsible for ensuring that these numbers are allocated in line with the provisions of the Act. Any breach of the provisions of this Declaration may result in civil or criminal consequences, although the specific penalties are not detailed within the text of this legislation. Under Australian law, penalties for breaches of telecommunications legislation can include fines and, in more serious cases, imprisonment. The exact penalties would depend on the nature and severity of the breach, as well as any relevant provisions in other related legislation. However, the text of this Declaration itself does not provide specific details on the penalties for non-compliance.
