  This Notice is the Telecommunications Labelling (Customer Equipment and Customer Cabling) Amendment Notice 2003 (No. 2).

4.9 Carrier permission and record keeping

 (1) This section applies in relation to an item of customer equipment that is to be:

 (a) connected to a carrier network or facility; and

 (b) used in the supply of public mobile telecommunication services mentioned in Category A53 in Part 2 of Schedule 1.

 (2) The supplier of the item must:

 (a) obtain written permission from the manager of the carrier network or facility for the item to be connected to the carrier network or facility; and

 (b) keep the written permission as a compliance record for the item.

Overview

The Telecommunications Labelling (Customer Equipment and Customer Cabling) Amendment Notice 2003 (No. 2) was enacted to amend the Telecommunications Labelling (Customer Equipment and Customer Cabling) Notice 2001, primarily to address the need for updated safety standards and other technical requirements for customer equipment and cabling in telecommunications. This notice was made by the Australian Communications Authority (ACA) under section 407 of the Telecommunications Act 1997. The overarching policy objective of this amendment is to ensure that telecommunications equipment complies with current safety and technical standards, thereby enhancing the safety and reliability of telecommunications services provided to consumers. This is achieved by updating the relevant standards and technical specifications referenced in the original notice to reflect the most recent industry standards and practices.

Scope and Application

The Telecommunications Labelling (Customer Equipment and Customer Cabling) Amendment Notice 2003 (No. 2) amends the Telecommunications Labelling (Customer Equipment and Customer Cabling) Notice 2001, impacting entities and individuals involved in the supply of customer equipment and cabling for telecommunications services in Australia. This notice applies to suppliers of customer equipment and cabling, specifically those who connect their equipment to a carrier network or facility and use it in the supply of public mobile telecommunications services. The amendments include updates to technical standards and compliance requirements, such as obtaining written permission from the carrier network manager and maintaining these permissions as part of the compliance records. The changes also reflect updates to relevant technical standards and their references, ensuring that equipment complies with current safety and performance requirements. The Notice extends its application across the Commonwealth of Australia, aligning with the broader objectives of the Telecommunications Act 1997, which it amends. There are no specific exclusions mentioned in this Notice; however, certain equipment, like surge protective devices, is excluded from the connector definition. The amendments commenced on gazettal, with specific provisions having different commencement dates as noted within the Notice.

Key Provisions

The Telecommunications Labelling (Customer Equipment and Customer Cabling) Amendment Notice 2003 (No. 2) amends the Telecommunications Labelling (Customer Equipment and Customer Cabling) Notice 2001, primarily through the insertion of new definitions, standards, and requirements. Notably, it introduces a new definition for "Public Mobile Telecommunications Service" (section 1.4) and modifies compliance records to include written permissions for certain customer equipment (subsection 1.5(6)). Additionally, it removes outdated standards and replaces them with more recent ones, such as replacing AS/ACIF S043-2001 with AS/ACIF S043.1-2003, AS/ACIF S043.2-2003, and AS/ACIF S043.3-2001 (Schedule 1, Part 1, clause 1, table). It also adds a new division, Division 4.5, which sets additional requirements for customer equipment used in the supply of public mobile telecommunications services, including the need for written permission from the carrier network or facility manager (section 4.9). The Notice imposes several obligations on suppliers of customer equipment and cabling. Suppliers must ensure their products comply with the specified technical standards and labelling requirements. This includes obtaining written permission from the carrier network or facility manager for certain items of customer equipment and maintaining these permissions as compliance records (section 4.9). Suppliers are also required to label their products accurately and include all necessary information as per the standards and categories outlined in the Notice. For instance, equipment used in public mobile telecommunications services must meet specific technical standards and labelling requirements (Schedule 1, Part 2, category A53).
