Overview

The Telecommunications (Interception and Access) (Emergency Service Facilities — Australian Capital Territory) Instrument 2008, as amended, is a legislative instrument made under subsection 6(2D) of the Telecommunications (Interception and Access) Act 1979. This instrument aims to facilitate the regulation of telecommunications interception and access specifically for emergency service facilities in the Australian Capital Territory. It was prepared by the Office of Legislative Drafting and Publishing, Attorney-General’s Department, and came into effect on the day after its registration on 13 March 2008. The primary objective of this instrument is to ensure that law enforcement agencies and emergency services can effectively carry out their duties while complying with relevant legislative requirements for telecommunications interception and access. This instrument revokes the previous Telecommunications (Interception and Access) (Emergency Service Facilities — Australian Capital Territory) Instrument 2007.

Scope and Application

The Telecommunications (Interception and Access) (Emergency Service Facilities — Australian Capital Territory) Instrument 2008, made under subsection 6(2D) of the Telecommunications (Interception and Access) Act 1979, applies specifically to the operations of certain emergency service facilities within the Australian Capital Territory. This legislative instrument identifies the premises operated by the Australian Federal Police in Belconnen, Greenway, and Fairbairn, as well as those operated by the ACT Emergency Services Agency in Curtin. It grants authorised officers the ability to intercept telecommunications under strict conditions as outlined in the Act and its accompanying declaration. The Instrument came into effect on the day after its registration and has been subject to amendments, with the latest significant changes occurring in 2010. These amendments refine the operational scope and administrative details of the facilities identified within the Instrument. The jurisdictional reach is limited to the Australian Capital Territory, and the application is restricted to the specified emergency service facilities and their operational premises.

Key Provisions

The Telecommunications (Interception and Access) (Emergency Service Facilities — Australian Capital Territory) Instrument 2008, as amended, sets out the specific facilities designated under the Telecommunications (Interception and Access) Act 1979 (TIA Act) for emergency services in the Australian Capital Territory (ACT). Section 5 of the Instrument identifies the facilities, specifying that the Australian Federal Police (AFP) operates premises in Belconnen and Greenway, and the AFP Operations Coordination Centre operates a facility in Fairbairn. Additionally, the ACT Emergency Services Agency operates a facility in Curtin. These facilities are designated to allow authorised officers to intercept telecommunications and access telecommunications data in accordance with the TIA Act. Under the Instrument, the designated emergency service facilities are obligated to comply with the TIA Act, which governs the authorisation and conduct of telecommunications interceptions and access by law enforcement agencies. The officers at these facilities must adhere to the requirements and limitations set out in the TIA Act, including obtaining the necessary authorisations before conducting any interception activities. The Instrument also specifies that these facilities are to be used solely for the purposes permitted by the TIA Act, ensuring that the privacy rights of individuals are protected and that any interception activities are conducted lawfully and within the scope of the Act. Breaches of the provisions of the TIA Act can result in both civil and criminal penalties. For instance, unauthorised interception of telecommunications is a criminal offence under section 132 of the TIA Act, carrying a maximum penalty of 10 years' imprisonment. Additionally, any misuse of intercepted data or failure to comply with the Act's requirements can lead to civil liabilities, including compensation for any loss or damage caused by the breach. The penalties underscore the importance of strict adherence to the legal framework governing telecommunications interceptions and access, ensuring that such activities are conducted responsibly and in accordance with the law.
