1  Name

  This instrument is the Telecommunications (Consumer Protection and Service Standards) (Specified Positions) Designation 2022.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument.

At the same time as Schedule 2 to the Telstra Corporation and Other Legislation Amendment Act 2021 commences.

 

However, the provisions do not commence at all if the Schedule does not commence.

 

Note: This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

 (2) Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

  This instrument is made under subsection 22B(2) of the Telecommunications (Consumer Protection and Service Standards) Act 1999 and subsection 4(2) of the Acts Interpretation Act 1901.

4  Definitions

  In this instrument:

Act means the Telecommunications (Consumer Protection and Service Standards) Act 1999.

5  Specified Positions

Each Senior Executive Service Band 1 or Band 2 employee in the Department with direct responsibility for the Telstra USO Performance Agreement, is designated for the purposes of subsection 22B(1) of the Act, including (without limitation), a person who from time to time, holds or performs the duties of the following positions:

 

 (a) First Assistant Secretary, Communications Services and Consumer;

 (b) Assistant Secretary, Consumer Safeguards; and

 (c) Assistant Secretary, Universal Service Guarantee.
