Overview

The Tasmania Grant Act 1936 was enacted to provide financial assistance to the State of Tasmania during a period of economic hardship. This legislation was introduced by the Parliament of Australia, with the aim of supporting Tasmania's budget and enabling the state to maintain essential public services and infrastructure. The Act authorises the appropriation of a sum of Six hundred thousand pounds, to be disbursed in equal monthly instalments from the Consolidated Revenue Fund starting from July 1936. The policy objective of the Act was to provide immediate financial relief to Tasmania, ensuring that the state could continue to function effectively despite its economic difficulties.

Scope and Application

The Tasmania Grant Act 1936 serves a specific financial purpose, facilitating the transfer of funds from the Commonwealth of Australia to the State of Tasmania. The Act is applicable to the government of Tasmania, intended to provide financial assistance to the state as stipulated. The monetary sum allocated under this Act is to be disbursed in equal monthly instalments throughout the financial year starting on the first day of July 1936. This Act is a Commonwealth law and thus has a national jurisdictional reach within Australia. The Act does not specify any exclusions, exemptions, or thresholds in its text. The application of this Act is confined to the allocation of the specified sum for the purpose of financial assistance to Tasmania, with no indication of broader applicability or extension through subordinate instruments.

Key Provisions

The Tasmania Grant Act 1936 primarily focuses on the financial assistance to be provided to the State of Tasmania, with the Act itself being a legal instrument to facilitate this process. Section 2 specifies the sum of Six hundred thousand pounds to be paid to Tasmania for financial assistance, to be disbursed over the fiscal year commencing on 1 July 1936. This payment is intended to provide support to Tasmania during that specific period. Section 3 outlines the method of payment, indicating that the amount will be paid in equal monthly instalments, ensuring a steady and predictable flow of funds to the state. The obligations imposed by this Act are primarily on the Commonwealth government, which is tasked with making the payments as specified. Section 4 ensures that these payments are made out of the Consolidated Revenue Fund, which is a central fund that collects all revenue from various sources and is then allocated to various expenses and grants as mandated by legislation. By appropriating funds from this central fund, the Act ensures that the financial assistance is available and properly managed through the established fiscal processes. In terms of legal consequences for non-compliance or breaches, the Act does not explicitly detail offences, penalties, or consequences for failure to make the payments as specified. However, given the nature of the Act and the obligations it imposes, it can be inferred that failure to comply with the payment schedule or the appropriation of funds could potentially lead to legal repercussions. The precise consequences would likely be determined by the courts or relevant authorities in the event of non-compliance, though the Act itself does not outline specific penalties or enforcement mechanisms.
