Overview

The Tasmania Grant Act 1934 was enacted by the Parliament of the Commonwealth of Australia to address a financial shortfall experienced by the State of Tasmania. Assented to on 4th August 1934, this Act authorises the payment of a sum from the Consolidated Revenue Fund to provide financial assistance to Tasmania. The Act specifies the payment of four hundred thousand pounds for the financial year commencing on the first day of July 1934, to be disbursed in equal monthly instalments. The policy objective is to alleviate the financial difficulties faced by Tasmania through federal support, thereby ensuring that the state can meet its financial obligations and continue its operations effectively.

Scope and Application

The Tasmania Grant Act 1934 is a Commonwealth Act that authorises the appropriation of funds from the Consolidated Revenue Fund for the purpose of providing financial assistance to the State of Tasmania. This Act applies specifically to the Commonwealth government and Tasmania, targeting the financial relationship between these entities for a specified period. The Act mandates that the sum of Four hundred thousand pounds be disbursed to Tasmania during the financial year starting on the first day of July 1934, with payments made in equal monthly instalments. The Act’s jurisdictional reach is confined to the Commonwealth and the State of Tasmania, establishing a clear framework for financial aid between these parties. The Act does not explicitly state any exclusions, exemptions, or thresholds, but it is implicit that the payment provisions apply uniformly unless otherwise specified by subordinate legislation. The Act itself does not extend or restrict its application through subordinate instruments, focusing primarily on the appropriation and payment processes.

Key Provisions

The Tasmania Grant Act 1934, as referenced in section 1, serves as the formal title of the legislation. Section 2 outlines the primary purpose of the Act, which is to provide financial assistance to the State of Tasmania. Specifically, the Act mandates the payment of Four hundred thousand pounds for this purpose during the fiscal year beginning on 1 July 1934. The method of payment, as stated in section 3, involves making the stipulated amount in equal monthly instalments. The appropriation of funds for these payments is detailed in section 4, which specifies that the payments will be made from the Consolidated Revenue Fund. The Tasmania Grant Act 1934 imposes certain obligations and requirements on the entities involved. Primarily, it places the responsibility on the Commonwealth to ensure the timely and accurate payment of the financial assistance to Tasmania as outlined in the Act. The obligation to disburse the funds in equal monthly instalments is a specific requirement that must be adhered to, ensuring a consistent flow of financial support to the state. Additionally, the appropriation of funds from the Consolidated Revenue Fund for this purpose establishes a clear financial source, ensuring that the payments are properly allocated and accounted for. Breaching the provisions of the Tasmania Grant Act 1934 can result in various consequences. While the Act itself does not explicitly outline specific offences, penalties, or maximum penalties for non-compliance, any failure to meet the requirements for payment or appropriation could lead to legal scrutiny. In the event of non-compliance, the Commonwealth could face legal action, and the responsible officials might be subject to disciplinary measures. The precise nature and extent of penalties would depend on the circumstances and any additional relevant legislation governing the administration and enforcement of the Act.
