Overview

The Tasmania Class 1 Agricultural Vehicle Dimension Exemption Notice 2016 (No.1) was enacted to address the specific needs of agricultural operations in Tasmania by providing exemptions from certain dimension requirements stipulated in the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. This statutory instrument was created under section 117 of the Heavy Vehicle National Law and is administered by the National Heavy Vehicle Regulator. The primary policy objective is to facilitate the efficient movement of agricultural vehicles on Tasmanian roads while ensuring road safety and infrastructure protection. The Notice applies to eligible vehicles, defined as agricultural vehicles or agricultural combinations, allowing them to operate within specified dimensions and conditions on roads classified as State highways or subsidiary roads and those controlled by local government authorities. The Notice exempts eligible vehicles from several dimension requirements, including length, width, height, and rear overhang, provided they adhere to specific conditions. These conditions include limits on vehicle width, length, height, and rear overhang, as well as requirements for warning signs, lights, and pilot vehicles under certain circumstances. The Notice also includes provisions for high-visibility markings on protruding axles and mandatory accompaniment by pilot vehicles for vehicles exceeding certain dimensions. This exemption Notice aims to balance the operational needs of the agricultural sector with public safety and infrastructure integrity.

Scope and Application

The Tasmania Class 1 Agricultural Vehicle Dimension Exemption Notice 2016 (No. 1) pertains specifically to agricultural vehicles operating within Tasmania, providing exemptions from certain dimension requirements outlined in Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. This Notice, which carries forward exemptions previously provided under the Vehicle and Traffic (Vehicle Operations) Notice 2013 (Tasmania), applies to eligible vehicles, defined as agricultural vehicles or combinations of such vehicles and trailers. The Notice imposes specific dimensional limitations: the width must not exceed 5 metres, the length for an agricultural vehicle should not exceed 15 metres, and for an agricultural combination, the limit is 25 metres. Additionally, the height must not exceed 4.6 metres, and the rear overhang must not surpass 5.5 metres. Vehicles must adhere to these conditions when operating on all roads in Tasmania, including state highways, state subsidiary roads, and roads controlled by local government authorities. The Notice also includes conditions for warning signs and lights, as well as requirements for pilot vehicles under certain circumstances. This Notice commences on 1 December 2016 and expires on 30 November 2021, unless otherwise altered by subordinate instruments.

Key Provisions

The Tasmania Class 1 Agricultural Vehicle Dimension Exemption Notice 2016 (No. 1) (the "Notice") provides an exemption from certain dimension requirements in Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation for agricultural vehicles operating in Tasmania. This Notice applies to eligible vehicles, which are defined as agricultural vehicles or agricultural combinations (a combination of a motor vehicle and a trailer, one of which is an agricultural vehicle) (section 6). The Notice exempts eligible vehicles from certain dimension requirements, including length, width, height, and rear overhang (section 8). However, there are still conditions that must be met. For example, the width of an eligible vehicle must not exceed 5 metres, and the length must not exceed 15 metres for an agricultural vehicle or 25 metres for an agricultural combination (section 10). The Notice also imposes obligations on parties governed by it, such as displaying warning signs and warning lights, complying with flag requirements, and using pilot vehicles (section 11). Failure to comply with the Notice may result in civil or criminal penalties, although the specific penalties are not outlined in the Notice. It is important for parties governed by the Notice to understand and comply with its requirements to avoid any potential consequences. The Notice imposes several obligations on the parties it governs. Firstly, eligible vehicles must comply with the conditions set out in section 10, which include limits on the width, length, height, and rear overhang of the vehicle. Secondly, if an eligible vehicle exceeds certain dimensions, it must display warning signs and warning lights as specified in section 11. Thirdly, if an eligible vehicle is a tractor, any axle that protrudes more than 150 millimetres past the outer wall of a tyre must be painted fluorescent yellow or be covered in a high-visibility material. Fourthly, eligible vehicles that exceed certain dimensions must be accompanied by pilot vehicles. Finally, agricultural vehicles that are agricultural implements and are towed at night must be fitted with brake lights, tail lights, and reflectors at the rear, either fixed to the implement or mounted on a detachable board. It is important for parties governed by the Notice to understand and comply with these obligations to avoid any potential consequences. While the Notice does not specify the penalties for breach, failure to comply with the requirements of the Notice may result in civil or criminal consequences. The Heavy Vehicle National Law (HVNL) provides for a range of penalties for breaches of the law, including fines and imprisonment. For example, section 208 of the HVNL provides for a maximum penalty of $22,200 for an individual who contravenes a provision of the HVNL that is expressed to be a criminal offence. Section 213 of the HVNL provides for a maximum penalty of $11,100 for an individual who contravenes any other provision of the HVNL. It is important for parties governed by the Notice to understand that failure to comply with its requirements may result in penalties under the HVNL or other applicable laws. In summary, the Tasmania Class 1 Agricultural Vehicle Dimension Exemption Notice 2016 (No. 1) provides an exemption from certain dimension requirements for agricultural vehicles operating in Tasmania. The Notice imposes conditions on eligible vehicles, including limits on their width, length, height, and rear overhang, as well as requirements for displaying warning signs and warning lights, complying with flag requirements, and using pilot vehicles. Failure to comply with the Notice may result in civil or criminal penalties, although the specific penalties are not outlined in the Notice. It is important for parties governed by the Notice to understand and comply with its requirements to avoid any potential consequences.
