Tasmania Class 1 Agricultural Vehicle Dimension Exemption Notice 2016 (No.1)

1. Purpose

The purpose of this Notice is to exempt agricultural vehicles operating in Tasmania from the stated dimension requirements in Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

Note: this Notice carries on the exemptions that were provided in Part 2 Division 4 of the Vehicle and Traffic (Vehicle Operations) Notice 2013 (Tasmania).

2.      Authorising Provisions

This Notice is made under section 117 of the Heavy Vehicle National Law (HVNL).

3.      Title

This notice may be cited as the Tasmania Class 1 Agricultural Vehicle Dimension Exemption Notice.

4.      Commencement

This Notice commences on 1 December 2016.

5.      Expiry

This Notice expires on 30 November 2021.

6.      Definitions

1)      Unless otherwise stated, words and expressions used in this Notice have the same meanings as in the Heavy Vehicle National Law.

2)      In this Notice -

Agricultural combination means a combination of a motor vehicle and a trailer, one of which is an agricultural vehicle.

Eligible vehicle means an agricultural vehicle or and agricultural combination.

7.      Application

This Notice applies to eligible vehicles in Tasmania.

8.      Exemption- Prescribed dimension requirements

1)      An eligible vehicle operating under this Notice is exempt from each of the following dimension requirements under Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the National regulation):

a)      Section 3(1)(a)- Length, combinations

b)      Section 3(1)(g)- Length, vehicles

c)      Section 4 (10)- Length, trailers

d)      Section 5(1)- Length, rear overhang

e)      Section 7(1)- Width

f)       Section 8(d)- Height

9.      Stated areas and routes

An eligible vehicle may use all roads in Tasmania that are:

a)      classified as a State highway or State subsidiary road within the meaning of the Roads and Jetties Act 1935; or

b)      a road controlled by a local government authority.

Note: Section 11 of Schedule 8 to the Heavy Vehicle (Mass, Dimension and Location) National Regulations requires drivers and operators to be satisfied that it is safe for the vehicle to be driven along the route without damaging the road or infrastructure.

10.  Conditions - dimensions

1)      The width of an eligible vehicle must not exceed 5 metres.

2)      The length of an eligible vehicle must not exceed:

a)      for an agricultural vehicle, 15 metres; or

b)      for an agricultural combination, 25 metres.

3)      The height of an eligible vehicle must not exceed 4.6 metres.

4)      The rear overhang of an eligible vehicle must not exceed 5.5 metres.

11.  Conditions – general

1)      Except where specified, the conditions in this part apply to eligible vehicles in the place of corresponding conditions in Schedule 8 of the National Regulation.

2)      If the agricultural vehicle (other than a tractor) exceeds 2.5 metres in width or 12.5 metres in length, an oversize vehicle warning sign must be displayed at the front and rear of the vehicle.

3)      If the agricultural combination exceeds 2.5 metres in width or 19.5 metres in length, an oversize vehicle warning sign must be displayed:

1. if a tractor is not the front vehicle of the combination, at the front and rear of the combination; and
2. if a tractor is the front vehicle of the combination, at the rear of the combination.

4)      If the agricultural vehicle or agricultural combination is not an agricultural machine, a warning light must be displayed on the agricultural vehicle or agricultural combination:

1. when used in daylight, if the agricultural vehicle or agricultural combination exceeds 3 metres in width; or
2. when used at night, if the agricultural vehicle or agricultural combination exceeds 2.5 metres in width or 22 metres in length.

5)      Where the agricultural vehicle (other than a tractor) exceeds 2.5 metres in width, the vehicle must comply with the requirements relating to flags in section 8 of Schedule 8 to the National Regulation.

6)      Any axle, on an agricultural vehicle that is a tractor, which protrudes more than 150 millimetres past the outer wall of a tyre must be painted fluorescent yellow or be covered in a high-visibility material.

7)      An agricultural vehicle that exceeds 3.5 metres in width must not be used at night.

8)      An agricultural vehicle that is used in daylight must be accompanied by a pilot vehicle if it exceeds:

1. 3.5 metres in width; or
2. 12.5 metres in length.

9)      An agricultural combination that exceeds 19 metres in length or 3.5 metres in width must be accompanied by a pilot vehicle.

10)  An agricultural vehicle which exceeds 4.5 metres in width must be accompanied by 2 pilot vehicles.

11)  An agricultural vehicle that is an agricultural implement that is towed at night must be fitted with brake lights, tail lights and reflectors at its rear, either fixed to the implement or mounted on a detachable board.
