Overview

The Tariff Board Regulations 1972 were enacted under the authority of the Tariff Board Act 1921-1972, and were made by the Administrator of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council. These regulations were designed to provide clarity and detail in relation to allowances and remuneration for members and authorities of the Tariff Board, filling a gap in the legislative framework that governed their compensation. The regulations outline specific allowances for various duties, including presiding at Board meetings, travelling, and service both within and outside Australia, aiming to ensure fair compensation for the officials involved in the operations of the Tariff Board. The policy objective underlying these regulations was to establish a transparent and consistent system of remuneration and allowances, aligning with the standards set for officers of the Public Service of the Commonwealth.

Scope and Application

The Tariff Board Regulations, made under the Tariff Board Act 1921-1972, apply to any period of office of a member or an authority on or after the seventh day of June, 1972. These regulations outline the allowances and remuneration for members of the Tariff Board and other authorities involved in the board’s activities. For members, various allowances are provided, such as an allowance for presiding at Board meetings or constituting a Division of the Board, and travelling allowances both within Australia and outside it. The Chairman and other members receive different rates for these allowances, with conditions such as the minimum duration of an inquiry before an allowance is payable. Authorities, who are not members of the Board, are entitled to specific remuneration for their services, capped at a maximum annual amount, and are also eligible for travelling allowances when they are necessarily away from their usual place of residence. The regulations ensure that the members and authorities receive appropriate compensation for their duties, aligning their allowances with those of comparable public service officers.

Key Provisions

The Tariff Board Regulations, made under the Tariff Board Act 1921-1972, provide specific guidelines and allowances for members and authorities of the Tariff Board. These regulations apply to any period of office starting from June 7, 1972. Section 4 of the regulations outlines the allowance for members presiding at Board meetings or constituting a division of the Board during an inquiry. Members, excluding the Chairman, an Acting Chairman, or a Deputy Chairman, are entitled to an allowance of $251 per year for the duration of an inquiry, provided the inquiry lasts at least one week. If the member is involved in multiple inquiries, the allowance is paid for one inquiry only. Section 5 addresses the travelling allowance for members who are necessarily absent from Canberra overnight while performing their duties. The Chairman is entitled to $34 per day, and other members receive $25 per day. This allowance is in addition to the cost of conveyance, which is not included. Furthermore, Section 6 specifies other allowances that members are entitled to while serving in Australia. These allowances are equivalent to those payable under the Public Service Regulations, with the Chairman being in the First Division and other members in the Second Division. Section 7 covers allowances for members performing duties outside Australia and the Commonwealth's territories. The Chairman is entitled to allowances equivalent to the Permanent Head of a Department, and other members receive allowances comparable to officers in the Second Division of the Public Service of the Commonwealth. Notably, members entitled to allowances for service outside Australia are not eligible for travelling allowance under Section 5. Regarding remuneration, Section 8 sets the annual remuneration for authorities, excluding Board members, at $4,500, plus an additional $275 for each inquiry undertaken. The total remuneration for an authority cannot exceed $9,000 per year, which is defined as a twelve-month period starting January 1. Section 9 provides for a travelling allowance for authorities who are necessarily absent from their usual place of residence overnight while performing their duties. The allowance is $25 per day, in addition to the cost of conveyance. Failure to comply with these regulations or to adhere to the specified allowances and remuneration may result in legal consequences, although specific penalties are not detailed in the text provided. The precise nature of any penalties or legal ramifications for non-compliance would depend on the overarching provisions of the Tariff Board Act 1921-1972 and any additional legislative instruments.
