GRAEME ALBERT WATERS

TITLES ADMINISTRATOR

ON BEHALF OF THE COMMONWEALTH-WESTERN AUSTRALIA

OFFSHORE PETROLEUM JOINT AUTHORITY

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a legislative framework for the regulation of offshore petroleum and greenhouse gas storage activities within Australia's maritime zones. This Act addresses the need for a coordinated approach to managing the environmental, economic, and social impacts of offshore petroleum exploration and production, particularly in the context of the country's commitment to reducing greenhouse gas emissions. The Act was passed by the Parliament of Australia and aims to facilitate the sustainable development of offshore petroleum resources while ensuring the protection of the marine environment. This legislation is crucial in establishing clear guidelines and regulatory processes for the exploration, development, and storage of offshore petroleum resources, thus ensuring that such activities are conducted in a manner that balances economic interests with environmental stewardship.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to the surrender of petroleum exploration permits within the Commonwealth and Western Australian offshore areas. Specifically, this Act governs the administrative procedures for the surrender of permits such as the Petroleum Exploration Permit WA-530-P, which pertains to Chevron Australia (WA-530-P) Pty Ltd and Woodside Energy Ltd. The Act applies to these entities as registered titleholders of the permit, outlining the legal framework for the surrender process. The geographic reach of this legislation is defined by the specific blocks listed under the permit, which are detailed in the map sheets SE49 and SE50 (Rowley Shoals). These blocks cover a vast area off the coast of Western Australia, indicating the jurisdictional scope of the permit. The surrender of this permit, as detailed in the notice, becomes effective on the date of its publication in the Australian Government Gazette. The Act does not specify exclusions, exemptions, or thresholds for this surrender, but it may be subject to any applicable subordinate instruments or regulations that further detail the administrative processes involved.

Key Provisions

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the "Act") contains several key sections that relate to the surrender of petroleum exploration permits. Section 271 provides the legal framework for the surrender of a petroleum exploration permit, while Section 708 outlines the specific requirements for the surrender of Petroleum Exploration Permit WA-530-P. According to these sections, the National Offshore Petroleum Titles Administrator, on behalf of the Commonwealth-Western Australia Offshore Petroleum Joint Authority, has issued a notice of the surrender of the whole of Permit WA-530-P. The permit, which is held by Chevron Australia (WA-530-P) Pty Ltd and Woodside Energy Ltd, includes a series of graticular sections described on specific map sheets. The Act imposes certain obligations and requirements on the parties involved in the surrender of the petroleum exploration permit. Firstly, the notice of surrender must be published in the Australian Government Gazette (Section 271). This public notification ensures transparency and informs stakeholders of the changes to the permit status. Additionally, the Act requires the permit holder to provide a detailed description of the blocks being surrendered, including the map sheet and graticular sections, to facilitate accurate record-keeping and future reference (Section 708). Failure to comply with the provisions of the Act can result in various civil or criminal consequences. For example, if a party fails to properly surrender a petroleum exploration permit as required by the Act, they may face legal action or penalties. While the specific penalties are not detailed in the provided excerpt, it is generally understood that breaches of the Act can lead to fines, imprisonment, or other sanctions as determined by the relevant authorities. The maximum penalties would depend on the nature and severity of the breach, as well as any applicable guidelines or precedents set by the courts. It is essential for parties involved in the surrender of petroleum exploration permits to adhere to the requirements set forth in the Act to avoid potential legal repercussions.
