Overview

The Supply (Works and Services) Act (No. 1) 1951–52 was enacted by the Parliament of the Commonwealth of Australia to address the need for the appropriation of funds for the year ending 30 June 1952, specifically for capital expenditure on additions, new works, and other services. The Act authorises the issue and application of £21,687,000 from the Consolidated Revenue Fund to various Commonwealth departments, services, business undertakings, and territories as detailed in the Schedule. This appropriation is intended to cover a range of activities including infrastructure, public services, and administrative expenses, ensuring the government could proceed with its planned capital projects for the financial year. The Act aims to provide a structured financial framework for these expenditures, ensuring that funds are allocated according to the specified purposes and timelines.

Scope and Application

The Supply (Works and Services) Act (No. 1) 1951–52 is an Australian Commonwealth Act that provides a financial appropriation for the service year ending 30 June 1952, specifically aimed at funding capital expenditures for additions, new works, and other services across various departments, business undertakings, and territories of the Commonwealth. The Act authorises the issuance and application of £21,687,000 from the Consolidated Revenue Fund, allocated to specified departments and entities as detailed in the Schedule, which includes major government departments such as the Department of Works and Housing, the Department of Civil Aviation, and the Department of Health, as well as business undertakings like the Commonwealth Railways and the Postmaster-General’s Department. Additionally, the Act extends its financial provisions to certain territories under the Commonwealth's jurisdiction, such as the Northern Territory and the Australian Capital Territory. The Act's financial provisions are strictly time-bound, prohibiting any expenditure after the specified service year end date of 30 June 1952.

Key Provisions

The Supply (Works and Services) Act (No. 1) 1951–52 is an Act that provides for the appropriation of funds for the financial year ending June 30, 1952, for capital expenditure in various departments, services, business undertakings, and territories of the Commonwealth. The Act authorizes the issuance and application of a specific sum, £21,687,000, from the Consolidated Revenue Fund for additions, new works, and other services involving capital expenditure (sections 3 and 4). The funds are to be allocated to specified departments and entities as detailed in the Schedule to the Act. Under this Act, the Treasurer is empowered to issue and apply the authorized sum for the purposes specified, and the sum is to be available to satisfy warrants under the hand of the Governor-General for these purposes (section 3). Importantly, the Act stipulates that no money shall be expended under its authority after the financial year ends, i.e., after June 30, 1952 (section 5). This ensures that the allocated funds are strictly used for the intended purposes within the specified timeframe. There are no explicit offences, penalties, or consequences for breaches detailed within the Act itself. However, any unauthorized expenditure beyond the stipulated period or misallocation of funds could potentially lead to administrative and legal repercussions under other relevant financial governance and public accountability laws. The Act primarily serves as a legal framework for the allocation and application of public funds for capital projects across various Commonwealth entities for the financial year in question.
