Overview
The Statutory Rules of 1943, No. 117, issued under the Supply and Development Acts 1939, amend the Supply and Development (Flax Production) Regulations. Enacted by the Governor-General in the context of the pressing need to regulate and support flax production during wartime, these regulations were introduced to ensure the efficient management and reporting of flax production funds. The enacting body was the Federal Executive Council, acting on advice from the Minister of State for Supply and Shipping. The regulation specifies that the Committee must submit an annual statement of accounts to the Minister, detailing all payments from the Trust Fund for Flax Production, along with comprehensive financial reports including a manufacturing account, a profit and loss account, and a statement of assets and liabilities. The overarching policy objective of these amendments is to enhance transparency and accountability in the management of flax production finances during a critical period of national importance.
Scope and Application
This statutory rule, made under the Supply and Development Acts 1939, amends the Supply and Development (Flax Production) Regulations to revise the financial reporting requirements for the flax production trust fund. Specifically, the regulation mandates that the Committee responsible for the flax production trust fund must submit to the Minister an annual statement of accounts, which includes a detailed breakdown of all moneys disbursed from the Trust Fund – Flax Production Account, along with a manufacturing account, a profit and loss account for the year's transactions, and a statement of assets and liabilities as of the financial year's end. This requirement ensures transparency and accountability in the financial management of the flax production activities under the auspices of the Supply and Development Acts. The amendment directly affects the flax production industry by imposing stringent financial reporting obligations, ensuring that all financial activities related to flax production are meticulously documented and reviewed annually.
Key Provisions
The main operative section of this legislative instrument is Regulation 17, which replaces an existing regulation (Regulation 17 of the Supply and Development (Flax Production) Regulations) with a new provision. This new regulation requires the Committee to submit several financial documents to the Minister at the end of each financial year (Regulation 17(a)-(b)). Specifically, the Committee must provide a statement of all moneys paid out of the Trust Fund—Flax Production Account, a manufacturing account, a profit and loss account of its transactions for the year, and a statement of assets and liabilities as at the close of the year.
The obligations imposed by this regulation are primarily on the Committee, which must ensure that it prepares and submits the required financial documents to the Minister. The Committee must account for all moneys paid out of the Trust Fund—Flax Production Account and provide detailed financial accounts for the year. This includes not only the financial transactions but also the assets and liabilities of the Committee as of the end of the financial year. The requirement to submit these documents ensures transparency and accountability in the management of funds allocated for flax production.
There are no explicit offences, penalties, or consequences for breach mentioned in this regulation. However, it can be inferred that failure to comply with the requirement to submit the annual financial statements could lead to administrative or legal consequences, such as investigations or audits, to ensure compliance with financial reporting obligations. The severity of any such consequences would depend on the specific circumstances and any additional legislation or regulations that may apply.
