Overview

The Supply Act (No. 2) 1990-91 was enacted in 1990 to provide interim financial appropriation for the year ending 30 June 1991. This Act was enacted by the Queen, the Senate, and the House of Representatives of the Commonwealth of Australia, addressing the need for interim financial provisions until the main Appropriation Act for the year could be passed. The policy objective of this Act is to facilitate the lawful issuance and application of funds from the Consolidated Revenue Fund for specified services and payments to or for the states, the Northern Territory, and the Australian Capital Territory. This Act allows the Minister for Finance to issue and apply funds for various services and payments, ensuring continuity of government operations and adherence to legal appropriations until the formal appropriation process is completed.

Scope and Application

The Supply Act (No. 2) 1990-91 is a Commonwealth Act that facilitates the appropriation of funds from the Consolidated Revenue Fund for the financial year ending on 30 June 1991. The Act applies to various government departments and services, including the Department of Administrative Services, the Department of the Arts, Sport, the Environment, Tourism and Territories, and the Attorney-General’s Department, among others. The funds are intended for specific services and purposes as outlined in Schedule 2, with particular attention to capital works, services, and payments to or for the states, the Northern Territory, and the Australian Capital Territory. The Act also includes provisions for payments under the National Estate Grants Program if a related amendment to the Australian Heritage Commission Act 1975 is enacted before the commencement of the Appropriation Act (No. 2) 1990-91. The application of the funds is governed by the terms and conditions set out in Schedule 1 and is subject to the Minister's determinations as specified in the Act. The Act applies nationally within the Commonwealth of Australia and does not include explicit exclusions or thresholds, though it does detail specific appropriations and their intended uses.

Key Provisions

The Supply Act (No. 2) 1990-91 primarily provides for the appropriation and application of funds from the Consolidated Revenue Fund for specific services and payments during the financial year ending on 30 June 1991. Section 3(1) allows the Minister for Finance to issue and apply $2,940,195,000 for the services listed in Schedule 2. The Act further specifies how these funds may be used: for Capital Works and Services (section 3(2)), payments to or for the States, Northern Territory, and Australian Capital Territory (section 3(3)), and generally mandates that the Consolidated Revenue Fund is appropriated as necessary (section 3(4)). Section 4 details the conditions and amounts for payments to States, requiring that such payments adhere to terms and conditions determined by relevant Ministers and made in specified amounts and times as per the Act's schedule. The Act imposes several obligations on the parties it governs. For example, it mandates that payments to States must be made according to specific terms and conditions determined by designated Ministers, as outlined in Schedule 1. Additionally, it provides that money appropriated for a particular program is designated for specific purposes, including payments under administered Acts and other program purposes as per earlier appropriations (section 6). Furthermore, the Act includes provisions for adjustments in appropriations if a National Estate Grants Program is established, requiring reductions in certain appropriations and reallocations for grants (section 5). There are no explicit offences, penalties, or criminal/civil consequences detailed within the text of the Act itself. However, the Act operates under the broader legislative framework of Australian law, where breaches of financial regulations or misuse of public funds could lead to legal consequences under other legislation, such as the Crimes Act 1914 or specific departmental regulations. The Act ensures that all appropriations and payments are conducted in accordance with the law and prescribed processes, thereby avoiding unauthorised or illegal use of funds.
