Printed for the Government of the Commonwealth by W. G. Murray at the Government Printing Office, Canberra

Overview

The Supply Act (No. 2) 1969-70 was enacted to make interim provision for the appropriation of funds from the Consolidated Revenue Fund for certain expenditures for the financial year ending on the 30th of June, 1970. The Act was assented to on the 4th of June 1969, and it came into operation on the same day. The policy objective of this Act was to allocate specific amounts of money to various departments and services to ensure the smooth operation of government functions for the mentioned financial year. The Act was enacted by the Queen, through the Australian Parliament, which comprises the Senate and the House of Representatives. The total amount appropriated for the financial year was $221,540,000, which was to be distributed among various government departments and services as specified in the Act. This Act aimed to address the need for financial planning and allocation for the federal government's operations for the specified financial year. By providing the necessary funds to different departments and services, the Act ensured that the government could continue to function effectively and deliver essential services to the public. Additionally, the Act facilitated the recovery of advances made during the financial year and allowed the Treasurer to make payments pending the issuance of a warrant from the Governor-General.

Scope and Application

The Supply Act (No. 2) 1969–70 provides interim appropriation of funds from the Consolidated Revenue Fund for specific services and expenditures required by various Commonwealth departments and entities for the financial year ending on 30 June 1970. This Act applies to the services and expenditures listed in the Schedule, which includes allocations for departments such as Civil Aviation, Customs and Excise, Education and Science, External Affairs, and many others, as well as payments to or for the states and special allocations for the Treasurer. The Act authorises the Treasurer to issue and apply the specified sum of $221,540,000 for the outlined purposes. This legislation operates on a national level within the Commonwealth of Australia, affecting federal departments and entities directly involved in the services listed. The Act does not explicitly state any exclusions, exemptions, or thresholds, but it is understood that the appropriation is contingent upon the specified services and expenditures detailed in the Schedule. Any further details or extensions of application may be provided through subordinate instruments, though none are specified in the Act itself.

Key Provisions

The Supply Act (No. 2) 1969–70 (the "Act") is structured to allow the Treasurer to issue and apply funds from the Consolidated Revenue Fund for specific services and expenditures during the financial year ending on June 30, 1970, totaling $221,540,000. Section 3(1) authorises the Treasurer to issue this sum, while Section 3(2) appropriates the Consolidated Revenue Fund to cover these expenditures. This allocation is detailed in the attached Schedule, which lists various departments and services, including the Department of Civil Aviation, the Department of Customs and Excise, the Department of Education and Science, and others, each with specified budgets for activities such as capital works, plant and equipment, and grants. The Act imposes specific obligations on the departments and entities it governs. Each department is required to utilise the funds allocated to them strictly for the purposes outlined in the Schedule. For instance, the Department of Civil Aviation is allocated $2,900,000 for navigational aids, communication, power, and lighting equipment, as well as for aircraft, launches, vehicles, engines, and equipment. Similarly, the Department of Education and Science is allocated $6,335,000 for activities such as the acquisition and erection of permanent buildings at the Australian National University, contributions to affiliated residential colleges, and the construction of the Canberra College of Advanced Education. Breaches of the Act's provisions can result in legal consequences. While the Act itself does not explicitly detail offences, penalties, or consequences for non-compliance, breaches of appropriations or misuse of funds could potentially lead to criminal or civil liabilities under other relevant Australian legislation. For example, misuse of public funds could be prosecuted under the Criminal Code Act 1995, which includes provisions for fraud and embezzlement, carrying significant penalties including fines and imprisonment. Additionally, internal oversight and audit mechanisms, as prescribed by other acts such as the Public Governance, Performance and Accountability Act 2013, may also be invoked to address any mismanagement or improper use of funds.
