Overview
The Supply Act (No. 2) 1965-66 was enacted to make interim provision for the appropriation of funds from the Consolidated Revenue Fund for specific expenditures during the financial year ending 30 June 1966. This Act was passed by the Parliament of Australia and received Royal Assent on 28 May 1965, thereby addressing the need for a timely allocation of funds to various government departments and services to ensure continuity in public services and infrastructure projects. The overarching policy objective of this Act was to facilitate the necessary financial resources to support the operational needs and developmental initiatives of the Commonwealth government for the specified period.
Scope and Application
The Supply (No. 2) Act 1965-66 is a Commonwealth legislative instrument that facilitates the appropriation of funds from the Consolidated Revenue Fund for designated services within the financial year ending on the thirtieth day of June 1966. The Act applies to various departments and entities, including the Department of Civil Aviation, the Commonwealth Scientific and Industrial Research Organisation, and the Department of External Affairs, among others, as detailed in the schedule to the Act. The Act also allocates funds to business undertakings such as the Commonwealth Railways and the Postmaster-General's Department, as well as to territories of the Commonwealth like the Australian Capital Territory and the Northern Territory. This Act, which comes into operation on the day of Royal Assent, provides the Treasurer with the authority to issue and apply the specified sum of £95,026,000 for the outlined services, with the Consolidated Revenue Fund being appropriated accordingly.
Key Provisions
The Supply Act (No. 2) 1965-66 (Section 1) is an interim provision for the appropriation of funds out of the Consolidated Revenue Fund for certain expenditures in respect of the financial year ending on 30th June 1966. The Act came into operation on the day it received Royal Assent (Section 2). The main operative provision of the Act is found in Section 3, which allows the Treasurer to issue and apply specific sums from the Consolidated Revenue Fund for services detailed in the Act's Schedule for the specified financial year. The total amount appropriated under this Act is £95,026,000.
Under the Act, the Consolidated Revenue Fund is appropriated to the extent necessary for the purposes of the services specified in the Schedule (Section 3(1)). The Schedule divides the appropriations into three parts: Part 1 allocates funds to various departments and services, excluding business undertakings and territories of the Commonwealth; Part 2 allocates funds to business undertakings; and Part 3 allocates funds to territories of the Commonwealth. The sum total of these allocations equals the total appropriation of £95,026,000. The individual allocations range from £1,050,000 to the Department of Civil Aviation to £1,761,000 to Broadcasting and Television Services, and £8,343,000 to the Australian Capital Territory, among others.
The Act imposes specific obligations on the Treasurer, who is authorised to issue the appropriated funds from the Consolidated Revenue Fund for the specified services (Section 3(1)). The Treasurer must ensure that the funds are applied strictly for the services listed in the Schedule. The Act does not impose specific obligations on other parties or entities beyond those implicit in the proper use of the allocated funds for the specified purposes.
There are no explicit offences, penalties, or consequences for breach outlined in the Act. However, any misuse of the appropriated funds would likely be subject to the general principles of public law and administrative law in Australia, which could include investigations, audits, and potential financial recovery or disciplinary action against individuals or entities found to have misapplied the funds. The maximum penalties for such breaches would depend on the specific nature of the breach and the applicable laws at the time.
