Overview

The Supplementary Appropriation (Works and Buildings) Act 1944-45 was enacted in 1946 to address the need for additional funding for works and buildings during the 1944-45 financial year. This Act was passed by the Parliament of Australia and received royal assent on 15 August 1946, with the appropriation taking effect from 12 September 1946. The purpose of this legislation was to allocate the sum of £476,117 from the Consolidated Revenue Fund for specified purposes, including additions, new works, and buildings, as outlined in the Schedule to the Act. The policy objective was to support the ongoing infrastructure needs of various government departments and services, ensuring that essential works and projects could be funded and completed in a timely manner. The Act appropriates funds across different categories, including departments and services, business undertakings, and territories of the Commonwealth. For example, it allocates £377,276 for departments and services, £98,007 for business undertakings such as the Commonwealth Railways and Postmaster-General’s Department, and £834 for the Australian Capital Territory. This distribution reflects the diverse range of infrastructure projects and equipment purchases that were necessary to support the operations of the federal government during this period.

Scope and Application

The Supplementary Appropriation (Works and Buildings) Act 1944-45 is an Australian Commonwealth Act that appropriates a further sum from the Consolidated Revenue Fund for the year ended 30 June 1945, specifically for additions, new works, buildings, and other related purposes. The Act applies to various departments and services of the Commonwealth of Australia, including but not limited to, the Parliament, Department of External Affairs, Department of the Treasury, Department of the Interior, Department of Civil Aviation, Commonwealth Railways, and the Postmaster-General's Department. The Act allocates funds across different categories: £377,276 for departments and services other than business undertakings and territories of the Commonwealth, £98,007 for business undertakings, and £834 for the territories of the Commonwealth. The Act does not explicitly mention any exclusions, exemptions, or thresholds, and its application is confined to the national jurisdiction of the Commonwealth of Australia. The Act may be extended or restricted through subordinate instruments, although this is not detailed in the text.

Key Provisions

The Supplementary Appropriation (Works and Buildings) Act 1944-45 (sections 1-2) is a legislative measure that designates the appropriation of a specified sum of money from the Consolidated Revenue Fund. Specifically, the Act appropriates £476,117 for the year ended 30 June 1945, for the purposes of additions, new works, buildings, and other related expenses as outlined in the Schedule to the Act. This appropriation is deemed to have been made from the commencement date of the Appropriation (Works and Buildings) Act 1944-45. The Act imposes certain obligations and requirements on the various departments and entities it governs. For instance, it mandates the allocation of funds to specific projects and services, as delineated in the Schedule. This includes expenditures on buildings, works, sites, fittings, and furniture for departments such as Parliament, the Department of External Affairs, and the Department of the Treasury. Additionally, it mandates that the funds be used strictly for the purposes outlined, ensuring that the appropriation is directed towards the intended projects and services. The Act does not explicitly outline offences, penalties, or consequences for breach within its text. However, it is implicit that any misuse or unauthorised use of the appropriated funds would be subject to the general legal and financial regulations governing public expenditure in Australia. Breaches could potentially lead to legal action under relevant laws, including possible penalties such as fines or other financial repercussions, as well as administrative or disciplinary measures depending on the context and severity of the breach.
