Overview

The Supplementary Appropriation (Works and Buildings) Act 1910–11 was enacted to provide additional funding for various government works and buildings during the fiscal year ending on 30 June 1911. This Act was introduced to address the need for supplementary appropriation to support ongoing and new construction projects across different government departments. The enacting body was the Parliament of Australia, which included the King's Most Excellent Majesty, the Senate, and the House of Representatives. The policy objective of the Act was to allocate a specific sum of money to various government projects, including the construction of a site and building for the Treasury Department, the establishment of a small arms factory in Lithgow, and the purchase of land for militia field artillery in Brisbane.

Scope and Application

The Supplementary Appropriation (Works and Buildings) Act 1910–11 pertains to the allocation of a specific sum from the Consolidated Revenue Fund for the financial year ending 30 June 1911. It primarily applies to the Commonwealth of Australia, authorising the Treasurer to issue and apply the granted sum of £61,175 towards additions, new works, and buildings as detailed in the schedule. This appropriation is under the control of the Department of Home Affairs and the Department of Defence, which are responsible for the specified projects, including the construction of a site and building for the Treasury Department and the establishment of a small arms factory in Lithgow. The scope of the Act is limited to these particular projects, as outlined in the schedule, and does not extend to other areas unless specified in subordinate instruments. The Act applies nationally, reflecting the federal structure of Australia, and its provisions are binding across all states and territories within the Commonwealth. There are no stated exclusions, exemptions, or thresholds within the text of the Act itself, although further details might be found in any related subordinate legislation.

Key Provisions

The Supplementary Appropriation (Works and Buildings) Act 1910–11 (section 1) provides for the appropriation of an additional sum of money from the Consolidated Revenue Fund for the year ending on 30 June 1911. This Act permits the Treasurer to issue £61,175 (section 2) and allocate this sum to specified purposes (section 3). The funds are designated for works and buildings related to the Treasury Department, including a new site and building (section 3, Schedule Division No. 1), and for defence-related projects such as a small arms factory in Lithgow, New South Wales, and land acquisition in Brisbane and Warwick, Queensland (section 3, Schedule Division No. 4). The Act imposes specific obligations on the Department of Home Affairs and the Department of Defence to ensure that the appropriated funds are used for the designated projects. The Department of Home Affairs is responsible for overseeing the construction of the Treasury Department's site and building, while the Department of Defence must manage the construction of the Lithgow small arms factory and the land purchases in Brisbane and Warwick. Each department must ensure that the allocated funds are utilised in accordance with the terms and conditions specified in the Act and the budget estimates outlined in the Schedule. Breach of the provisions of this Act could result in legal consequences. While the Act itself does not explicitly outline specific penalties for non-compliance, any misuse of the appropriated funds could potentially lead to civil or criminal liability under other applicable laws. The maximum penalties would depend on the nature and severity of the breach, but could include fines or other financial penalties, and in severe cases, imprisonment. The enforcement of these penalties would be subject to the relevant laws governing public funds and financial mismanagement.
