Overview
The Supplementary Appropriation Act 1921-22 was enacted by the Commonwealth of Australia to address the need for additional funding beyond what was initially allocated for the fiscal year ending 30 June 1922. This Act authorises the Treasurer to issue a specific sum from the Consolidated Revenue Fund to make up for the shortfall in the budget, as initially approved by the House of Representatives. The Act was assented to on 22 December 1921, ensuring that the necessary funds could be mobilised to meet the financial requirements of the government for the remainder of the fiscal year. The purpose of this Act is to legally sanction the allocation of £25 for specified purposes, which are detailed in the Schedule attached to the Act. This supplementary appropriation was necessary to support the ongoing operations of the government, including specific increases in salary as outlined in the detailed schedule.
Scope and Application
The Supplementary Appropriation Act 1921-22 applies to the Commonwealth of Australia and pertains specifically to the issuance and application of a supplementary appropriation from the Consolidated Revenue Fund for the fiscal year ending 30 June 1922. This Act authorises the Treasurer to allocate £25 from the Consolidated Revenue Fund to address an additional financial requirement identified during the fiscal year. The funds are designated for the specific purpose outlined in the attached schedule, which details the allocation for a special messenger in charge of stores and stamping correspondence within the Senate, resulting in an increase to their salary. The Act is geographically confined to the national jurisdiction of the Commonwealth of Australia, and there are no explicit exclusions, exemptions, or thresholds stated within the text of the Act itself. However, the application and interpretation of this Act may be extended or restricted through subordinate instruments or administrative guidelines, which are not detailed in the provided text.
Key Provisions
The main operative sections of the Supplementary Appropriation Act 1921-22 include Section 2, which allows the Treasurer to issue £25 from the Consolidated Revenue Fund for the year ending 30 June 1922, and Section 3, which specifies that this sum is to be appropriated for the purpose outlined in the Schedule. The Schedule lists the specific allocation of the funds, detailing that an increase of £25 is to be granted to the Special Messenger in charge of stores and stamping correspondence in the Senate.
The Act imposes certain obligations on the parties involved. The Treasurer is required to issue and apply the specified sum as per the Act. The funds must be utilised strictly for the purpose stated in the Schedule, which in this case is an increase in salary for the Special Messenger in the Senate. Compliance with these allocations is essential, ensuring that the appropriation is used as intended by Parliament.
There are no explicit provisions detailing offences, penalties, or consequences for breach within the Act. However, any misuse or misapplication of the funds would likely be subject to general public service laws and regulations governing financial management and appropriation. Breaches could potentially lead to civil or criminal penalties depending on the severity and intent of the breach, though such consequences are not specified in the text of this Act.
