Superannuation Act 2005

Declaration under paragraph 13(2)(h)

Superannuation (PSSAP) Membership Eligibility (Exclusion) Amendment Declaration 2007 (No. 1)

The Superannuation Act 2005 (the Act) makes provision for, and in relation to, the Public Sector Superannuation Accumulation Plan (PSSAP) for public sector employees and certain other persons.  Under the Act an employer of an ordinary employer-sponsored member of PSSAP must pay employer superannuation contributions to the PSSAP Fund for that member in accordance with the Rules within the meaning of the Act.

Section 13 of the Act specifies the various persons who are eligible to become members of the PSSAP.  Paragraph 13(2)(h) provides that a person is not eligible to become a member of PSSAP if the person is specified in a written declaration made by the Minister.

The Superannuation (PSSAP) Membership Eligibility (Exclusion) Declaration 2005 (the Principal Declaration) made under paragraph 13(2)(h) of the 2005 Act identifies those persons who are declared ineligible to become a PSSAP member.

The purpose of this Declaration cited as the Superannuation (PSSAP) Membership Eligibility (Exclusion) Amendment Declaration 2007 (No.1) (the Amending Declaration) is to amend Schedule 1 of the Principal Declaration to include certain Mersey Hospital APS Employees, as persons who are ineligible to become a PSSAP member.

As the Amending Declaration affects Mersey Hospital APS Employees, the Department of Health and Ageing was consulted.

The Amending Declaration is a legislative instrument for the purposes of the Legislative Instruments Act 2003 and is subject to disallowance but not sunsetting.

The Amending Declaration commences on the day after registration on the Federal Register of Legislative Instruments.

The details of this Amending Declaration are explained in the attachment.

Superannuation (PSSAP) Membership Eligibility (Exclusion) Amendment Declaration 2007 (No. 1)

Section 1 - Name of Declaration

This section provides that the name of the Declaration is the Superannuation (PSSAP) Membership Eligibility (Exclusion) Amendment Declaration 2007 (No. 1).

Section 2 - Commencement

This section provides for the Declaration to commence on the day after it is registered.

Section 3 - Amendments to the Superannuation (PSSAP) Membership Eligibility (Exclusion) Declaration 2005

This section amends the Superannuation (PSSAP) Membership Eligibility (Exclusion) Declaration 2005 by inserting after item 11 of Schedule 1, a new class of person, who is ineligible for membership of PSSAP, that is, a person who is a Mersey Hospital APS Employee and immediately before that employment, the person was not an ordinary employer-sponsored member of PSSAP.

This allows a person who is an ordinary employer-sponsored member of PSSAP because of particular employment, to retain their membership if they become a Mersey Hospital APS Employee.

A Mersey Hospital APS Employee is defined in the Public Service Act 1999 Determination under subsection 24(3), made on 30 October 2007, as an APS employee in the Department of Health and Ageing who performs duties in the Mersey Hospital, Tasmania.

Overview

The Superannuation Act 2005 was enacted to provide for the Public Sector Superannuation Accumulation Plan (PSSAP) and related matters for public sector employees and other specified individuals. This Act addresses the need for a comprehensive framework governing the accumulation of superannuation benefits for certain employees, ensuring that these individuals have access to a structured retirement savings scheme. The Superannuation (PSSAP) Membership Eligibility (Exclusion) Amendment Declaration 2007 (No. 1) was introduced by the Minister for Finance and Administration under the authority granted by the Superannuation Act 2005. This amendment was necessary to exclude certain Mersey Hospital APS Employees from PSSAP membership, thereby clarifying eligibility criteria and maintaining the integrity of the superannuation system. The policy objective of this amendment is to refine the membership criteria for the PSSAP, ensuring that only those individuals who meet the specified conditions are eligible to participate in the plan.

Scope and Application

The Superannuation Act 2005 governs the Public Sector Superannuation Accumulation Plan (PSSAP) which is designed for public sector employees and certain other persons. This legislation mandates employers to contribute to the PSSAP Fund for eligible members in accordance with the Act's rules. Section 13 of the Act specifies eligibility criteria for PSSAP membership, while paragraph 13(2)(h) allows for exclusions based on a written declaration by the Minister. The Superannuation (PSSAP) Membership Eligibility (Exclusion) Declaration 2005 initially identified ineligible persons, and the Superannuation (PSSAP) Membership Eligibility (Exclusion) Amendment Declaration 2007 (No. 1) further amended this list to include certain Mersey Hospital APS Employees as ineligible for PSSAP membership. This amendment was made in consultation with the Department of Health and Ageing and applies to individuals who were not ordinary PSSAP members before being employed at Mersey Hospital in Tasmania. The amendment commenced on the day after registration on the Federal Register of Legislative Instruments and is subject to disallowance under the Legislative Instruments Act 2003.

Key Provisions

The Superannuation (PSSAP) Membership Eligibility (Exclusion) Amendment Declaration 2007 (No. 1) primarily serves to amend the eligibility criteria for membership in the Public Sector Superannuation Accumulation Plan (PSSAP). Section 3 of the Declaration introduces a new category of individuals who are ineligible for PSSAP membership: those who are Mersey Hospital APS Employees and were not ordinary employer-sponsored members of PSSAP immediately prior to their employment at Mersey Hospital. This amendment ensures that individuals who transition from another role where they were ordinary employer-sponsored PSSAP members can retain their PSSAP membership if they become Mersey Hospital APS Employees. The obligations under this Act primarily revolve around the eligibility criteria for PSSAP membership. Employers must ensure that only those individuals who meet the eligibility requirements, as specified under Section 13 of the Superannuation Act 2005, are included as PSSAP members. The Declaration specifies that certain Mersey Hospital APS Employees are excluded from PSSAP membership. Employers must verify the employment status and PSSAP membership history of prospective employees to comply with the exclusion criteria outlined in the Declaration. Failure to adhere to the provisions outlined in the Declaration can result in significant consequences. Specifically, any employer who fails to comply with the eligibility requirements may be subject to penalties. While the Act does not explicitly detail the penalties for non-compliance, it is implied that incorrect classification of PSSAP membership could lead to financial liabilities or legal repercussions for the employer. Employers are thus required to maintain accurate records and ensure strict adherence to the eligibility criteria to avoid any potential breaches. The Declaration is a legislative instrument governed by the Legislative Instruments Act 2003, which means it is subject to disallowance but not sunsetting. This implies that Parliament can annul the Declaration if it chooses to do so, but it does not automatically expire after a certain period. The commencement of the Declaration is specified in Section 2, which states that it will take effect on the day following its registration on the Federal Register of Legislative Instruments. This ensures that the changes in eligibility criteria are implemented promptly and officially recognised. In summary, the Superannuation (PSSAP) Membership Eligibility (Exclusion) Amendment Declaration 2007 (No. 1) introduces specific exclusions for Mersey Hospital APS Employees in relation to PSSAP membership, imposes obligations on employers to verify eligibility, and outlines the legislative framework governing its implementation and potential consequences for non-compliance.
