Overview
The Superannuation (PSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 1, made in 2002 by the PSS Board under the authority granted by the Superannuation Act 1990, aims to establish conversion factors necessary for calculating the yearly amount required to discharge a liability equal to a person's Surcharge Commutation Amount. This determination was enacted to ensure the accurate computation of these amounts as advised by an actuary, in line with the provisions of the Public Sector Superannuation Scheme. The conversion factors, set out in the Schedule, are integral for the administration of pensions under rule 15.1.9 of the Rules for the Administration of the Public Sector Superannuation Scheme.
The enactment of this determination by the PSS Board reflects the need for precise actuarial calculations to manage pension liabilities effectively. This legislative instrument is a critical component in the administration of superannuation, ensuring that the financial obligations related to surcharge commutation amounts are accurately determined and managed.
Scope and Application
The Superannuation (PSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 1 applies specifically to the calculation of the surcharge commutation amount for pensions under the Public Sector Superannuation Scheme (PSS), as administered by the PSS Board. This determination is applicable to individuals who are members of the PSS and who are required to commute their surcharge liabilities. The legislation sets out the conversion factors to be used in determining the yearly amount needed to discharge a liability equal to a person’s surcharge commutation amount, based on their age at their last birthday. This determination is in line with the Superannuation Act 1990 and the rules governing the administration of the PSS, specifically rule 15.1.9. The conversion factors are outlined in the Schedule to this determination and are used in conjunction with actuarial advice to ensure accuracy and fairness in the calculation of pension liabilities.
Key Provisions
The main operative sections of this determination, titled "Superannuation (PSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 1", establish the conversion factors to be used under rule 15.1.9 of the Rules for the Administration of the Public Sector Superannuation Scheme. This is detailed in the Schedule of the Determination (sections 5 and Schedule). These conversion factors are intended to calculate the yearly amount that would be necessary to discharge a liability equal to a person's Surcharge Commutation Amount. The determination also includes a definition of terms used within the document (section 4) and specifies its commencement date (section 2). The purpose of the determination is clearly stated as determining the conversion factors in accordance with actuary advice (section 3).
The obligations imposed by this determination on the parties it governs are primarily concerned with the calculation of superannuation liabilities. It requires that the conversion factors provided in the Schedule be used to work out the yearly amount that would be required to discharge a liability equal to the person’s Surcharge Commutation Amount. The conversion factors are age-based and vary according to the age of the person at their last birthday. These factors are essential for accurately calculating the necessary annual payments to satisfy the Surcharge Commutation Amount liability.
Under this determination, there are no explicit offences or penalties stated for breaches. However, inaccuracies in the use of these conversion factors could potentially lead to incorrect calculations of pension liabilities, which may have legal and financial repercussions. For instance, using incorrect factors could result in under- or over-funding of pension liabilities, leading to disputes or financial mismanagement. While the determination itself does not specify maximum penalties, any resulting financial discrepancies or failures to meet pension obligations might be subject to other legal or administrative consequences under the broader Superannuation Act 1990 or related regulations.
