Overview
The Superannuation (PSS) Fees Regulations 1993, Statutory Rules 1993 No. 200, as amended, were enacted under the Superannuation Act 1990. These regulations address the issue of setting fees for requests to reconsider decisions made by the Commonwealth Superannuation Corporation (CSC) in relation to superannuation matters. The primary purpose of these regulations is to establish a standardised fee of $150 for individuals who wish to request CSC to reconsider a decision, as outlined in subsection 40(1) of the Act. The enacting body for these regulations is the Parliament of Australia, and the policy objective is to ensure a consistent and transparent fee structure for such reconsideration requests, thereby providing clarity and predictability for those engaging with CSC regarding their superannuation matters. The regulations have been amended over time to keep pace with legislative changes and to reflect any necessary updates to the fee structure.
Scope and Application
The Superannuation (PSS) Fees Regulations 1993, as amended, apply to individuals and entities that are subject to the Superannuation Act 1990, particularly those who may seek a reconsideration of decisions made by the Commonwealth Superannuation Corporation (CSC). This includes superannuation fund trustees and members of the public who request the reconsideration of decisions related to superannuation payments and other related matters. The regulations specify that a fee of $150 is payable for each request for reconsideration, thus providing a financial mechanism for managing the administrative burden associated with such requests. The geographic reach of these regulations is national, applying across Australia as they are made under the Commonwealth Superannuation Act 1990. There are no explicit exclusions or exemptions stated in these regulations, meaning that the fee applies to all eligible requests for reconsideration without exception. The application of these regulations can be extended or modified through subordinate instruments, as evidenced by the amendments listed in the notes, such as the amendment in 2011 which updated certain provisions of the original regulations.
Key Provisions
The Superannuation (PSS) Fees Regulations 1993, made under the Superannuation Act 1990, specify the fees payable for certain actions related to superannuation decisions. The primary operative section, subsection 40(1) of the Act, mandates that a fee of $150.00 must be paid by an individual who requests the Commonwealth Superannuation Corporation (CSC) to reconsider one of its decisions (Regulation 3). This fee is intended to cover the administrative costs associated with reviewing the decision.
These Regulations impose a financial obligation on individuals who seek to have CSC reconsider its decisions, ensuring that the process is not used frivolously. The fee must be paid at the time of the request for reconsideration, and failure to do so may result in the request being considered invalid (Regulation 3). The Regulations are designed to streamline the reconsideration process by ensuring that all requests are accompanied by the required fee, thereby maintaining the efficiency and effectiveness of the CSC's operations.
Breaching the provisions of the Superannuation (PSS) Fees Regulations 1993 by not paying the stipulated fee when requesting reconsideration of a CSC decision could lead to administrative consequences. Specifically, if the fee is not paid, the request for reconsideration may be rejected outright, and no further action will be taken on the request. This means that the individual will not receive a reconsideration of the decision, and any potential benefits or rights they sought through this process will remain unaddressed. It is crucial for individuals to adhere to the fee requirements to ensure their requests are processed in a timely and effective manner.
