Overview

The Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 4, enacted in 2003, amends the Superannuation Act 1976 by replacing the conversion factors used in calculating pension reductions for discharging surcharge deduction amounts. This determination was made by the CSS Board under the authority of the Act and in response to advice from the Australian Government Actuary. The purpose of this legislative instrument is to provide updated conversion factors that reflect current actuarial assessments, thereby ensuring the accuracy and fairness of the surcharge deduction calculations for both indexed and non-indexed pensions. This amendment revokes the previous Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 3, replacing it with new factors that are detailed in the schedule to this determination.

Scope and Application

The Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 4 applies to entities and individuals involved in the administration and management of superannuation funds as outlined in the Superannuation Act 1976. This includes trustees, fund managers, and other relevant parties who must adhere to the new conversion factors specified within the determination. The determination primarily concerns the calculation of pension reductions to discharge surcharge deduction amounts, thus impacting those who are receiving or have received pensions from superannuation funds. The jurisdiction of this determination is Commonwealth, meaning it applies nationally across Australia. There are no explicit exclusions or exemptions mentioned in the determination, but it is understood that it applies to all relevant superannuation funds operating within Australia. The application of the Act may be further extended or restricted through subordinate instruments, although this is not explicitly detailed in the determination itself.

Key Provisions

The Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 4, which takes effect from 1 July 2003, is a legislative instrument under the Superannuation Act 1976. It aims to set new conversion factors for calculating pension reductions to discharge surcharge deduction amounts, as advised by the Australian Government Actuary. The determination replaces the previous conversion factors set out in the Superannuation (CSS) (Surcharge Deduction Amount – Conversion Factors) Determination No. 3 with new ones, as detailed in Tables 1 and 2 of the Schedule to this determination. These new conversion factors pertain to indexed and non-indexed pensions and deferred benefits payable as indexed and non-indexed pensions, respectively. Entities and individuals governed by this Act must adhere to the new conversion factors for calculating pension reductions. This includes complying with the updated conversion factors outlined in Table 1 for indexed pensions and Table 2 for non-indexed pensions. The Act mandates that these new conversion factors be used when discharging surcharge deduction amounts, ensuring that pension calculations are accurate and up-to-date in accordance with the latest determinations. Breach of the requirements set out in this determination could lead to civil or criminal consequences. While specific penalties are not outlined in the text, penalties for breaches of the Superannuation Act 1976 generally include fines and imprisonment. The maximum penalties can vary based on the severity of the breach, the intent behind it, and other relevant factors. It is essential for entities and individuals to ensure compliance with the new conversion factors to avoid any potential legal repercussions.
