Overview

The Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 2 was enacted in 2001 by the CSS Board under the authority of the Superannuation Act 1976. This legislative instrument was introduced to address the need for updated conversion factors to be used when calculating pension reductions necessary to discharge surcharge deduction amounts, ensuring these factors align with the advice from the Australian Government Actuary. The purpose of this determination is to replace the outdated conversion factors with new ones that better reflect current actuarial advice, thereby improving the accuracy of pension deductions related to surcharges. The enacting body was the CSS Board, which operates under the oversight of the Superannuation Act 1976, aiming to ensure that the financial mechanisms for pension deductions are both fair and accurate.

Scope and Application

The Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 2, made under the Superannuation Act 1976, applies to the calculation of pension reductions to discharge surcharge deduction amounts for both indexed and non-indexed pensions and deferred benefits payable as indexed or non-indexed pensions. This legislative instrument was issued by the CSS Board and came into effect on 8 February 2001, with the purpose of setting new conversion factors to be used in these calculations. The conversion factors for indexed pensions and deferred benefits payable as indexed pensions are found in Table 1, while those for non-indexed pensions and deferred benefits payable as non-indexed pensions are in Table 2. The Act applies to all relevant entities and individuals within the Commonwealth of Australia, ensuring that the surcharge deduction amounts are accurately calculated based on the updated conversion factors. The determination replaces the factors set out in the Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 1, thereby updating the legislative framework in accordance with advice from the Australian Government Actuary.

Key Provisions

The Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 2, which came into effect on 8 February 2001, is a legislative instrument that replaces the conversion factors set out in the earlier Superannuation (CSS) (Surcharge Deduction Amount - Conversion Factors) Determination No. 1. This determination was made under subsections 154AB(1) and (2) of the Superannuation Act 1976 to ensure accurate calculation of pension reductions necessary for discharging surcharge deduction amounts, as advised by the Australian Government Actuary. The determination includes new conversion factors for indexed pensions (Table 1) and non-indexed pensions (Table 2) that replace the previous factors listed in the Principal Determination. The determination imposes specific obligations on parties involved in superannuation arrangements. Trustees of superannuation funds must use the new conversion factors specified in this determination when calculating the pension reductions required to discharge surcharge deduction amounts. This includes adjustments to indexed and non-indexed pensions and deferred benefits payable as indexed or non-indexed pensions. Failure to comply with these obligations can result in incorrect calculations, potentially leading to financial discrepancies or non-compliance with the Act. Breach of the obligations imposed by this determination can have significant legal consequences. While the determination does not explicitly outline specific offences, penalties, or civil/criminal consequences, non-compliance with the Superannuation Act 1976 can lead to penalties under the Act. For instance, under section 158 of the Superannuation Act 1976, trustees who fail to comply with their obligations may be subject to penalties, including fines. The maximum penalties can vary depending on the nature and severity of the breach, but they can include substantial financial penalties and, in severe cases, imprisonment. Additionally, trustees may face legal action from affected members or regulatory enforcement actions by the Australian Securities and Investments Commission (ASIC).
