Overview

The Superannuation (CSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 2 was enacted in 2003 by the CSS Board under the authority granted by the Superannuation Act 1976. This legislative instrument was introduced to address the need for updated conversion factors to accurately calculate the yearly amount that would need to be paid to discharge a liability equivalent to a person's surcharge commutation amount, as advised by an actuary. The CSS Board, acting within its powers as delegated by the Parliament of Australia, determined these new conversion factors to ensure the accuracy and fairness of superannuation calculations. The overarching policy objective of this determination is to maintain the integrity and functionality of the superannuation system by providing precise conversion factors that are essential for the correct valuation of pension liabilities.

Scope and Application

The Superannuation (CSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 2, made under the Superannuation Act 1976, applies to the Commonwealth of Australia and affects the calculation of surcharge commutation amounts for superannuation. This determination specifically replaces the conversion factors used in determining the yearly amount that would have to be paid to discharge a liability equal to a person's surcharge commutation amount, as per advice from an actuary. The new conversion factors provided in the Schedule apply to indexed and non-indexed pensions and deferred benefits payable as indexed or non-indexed pensions. The determination came into effect on 1 July 2003 and replaces the conversion factors specified in the earlier Superannuation (CSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 1. This legislative instrument extends the application of the Superannuation Act 1976 by specifying new conversion factors, thereby influencing the financial calculations related to superannuation benefits.

Key Provisions

The Superannuation (CSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 2, which takes effect from 1 July 2003, establishes new conversion factors for determining the yearly amount that would need to be paid to discharge a liability equal to a person's surcharge commutation amount. These factors are based on advice from an actuary and are detailed in the schedules of the determination (sections 3 to 7). The determination replaces the conversion factors in the previous determination (section 4). The determination outlines specific obligations for parties governed by the Superannuation Act 1976, primarily requiring adherence to the new conversion factors detailed in the schedules for indexed and non-indexed pensions (section 6 and 7). These obligations ensure consistency and accuracy in the calculation of surcharge commutation amounts, thereby facilitating compliance with superannuation regulations. Failure to comply with the provisions of this determination may result in financial penalties or other consequences, although specific penalties are not mentioned in the text. The consequences of non-compliance would likely be addressed under the broader provisions of the Superannuation Act 1976, which could include fines or other enforcement actions as deemed appropriate by the relevant authorities. The exact nature and extent of these penalties would depend on the specific circumstances and the discretion of the enforcing body.
