Overview

The Superannuation Act 1976, enacted to establish a framework for the regulation of superannuation funds in Australia, sought to address issues related to the commutation of benefits and the conversion of pension liabilities. This legislation was enacted by the Parliament of Australia to ensure the proper administration and management of superannuation funds, aiming to provide a secure retirement income for Australians. The Superannuation (CSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 1, issued in 2002, was made by the CSS Board under the authority granted by the Superannuation Act 1976. The primary purpose of this determination is to establish conversion factors for calculating the yearly amount required to discharge a liability equal to an individual's surcharge commutation amount, based on actuarial advice. These conversion factors are intended to aid in the accurate computation of pension benefits for both indexed and non-indexed pensions, ensuring that superannuation fund obligations are met effectively.

Scope and Application

The Superannuation (CSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 1 is a legislative instrument issued under the Superannuation Act 1976 by the CSS Board, which is tasked with determining conversion factors for calculating the surcharge commutation amount in superannuation contexts. This determination applies to individuals and entities managing superannuation funds and is specifically concerned with conversion factors relevant to both indexed and non-indexed pensions. The factors are designed to assist in calculating the yearly payments necessary to discharge a liability equivalent to a person's surcharge commutation amount, as advised by an actuary. The determination delineates the conversion factors applicable for various age groups, as detailed in the accompanying schedules, and is effective as of 22 August 2001. It applies nationally, encompassing all Commonwealth jurisdictions, and is an instrument that may be further elaborated or amended through subordinate legislation.

Key Provisions

The Superannuation (CSS) (Surcharge Commutation Amount - Conversion Factors) Determination No. 1 is a legislative instrument issued by the CSS Board under the authority of the Superannuation Act 1976. The primary function of this determination, as outlined in section 3, is to establish conversion factors to calculate the yearly amount required to discharge a liability equal to a person's surcharge commutation amount. These factors are intended to apply to both indexed and non-indexed pensions and deferred benefits, as specified in sections 5 and 6 respectively. The determination references two tables in its schedule, Table 1 for indexed pensions and Table 2 for non-indexed pensions, each providing conversion factors based on age at last birthday. Entities and individuals governed by this determination must adhere to the conversion factors specified in the Schedule. These conversion factors are crucial for accurately calculating the commutation amounts for pensions and deferred benefits. By utilising the appropriate conversion factors, entities can ensure compliance with the requirements set forth in the Superannuation Act 1976. The obligation lies with those managing or administering superannuation benefits to implement these factors correctly in their calculations. Failure to comply with the conversion factors outlined in this determination may lead to legal repercussions. Although the determination itself does not explicitly state offences, penalties, or consequences for non-compliance, breaches of the Superannuation Act 1976 can result in civil or criminal penalties. Such penalties can include fines and imprisonment, depending on the severity and intent behind the breach. The specific penalties are defined elsewhere in the Superannuation Act 1976 and can vary based on the nature of the offence. Therefore, adherence to the conversion factors is not only a matter of compliance but also of legal necessity to avoid potential sanctions.
