REGULATION UNDER THE SUPERANNUATION ACT 1976*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Superannuation Act 1976.

AMENDMENT OF THE SUPERANNUATION (APPROVED AUTHORITIES) REGULATIONS†

Regulation 2 of the Superannuation (Approved Authorities) Regulations is repealed and the following regulation substituted:

“ 2. Each of the following bodies is an approved authority for the purposes of the Superannuation Act 1976:

Australian Maritime College

Australian Meat and Live-stock Corporation

Calvary Hospital A.C.T. Incorporated

Canberra Commercial Development Authority

Commonwealth Accommodation and Catering Services Limited

Legal Aid Commission (A.C.T.)

Northern Territory of Australia.”.

Incorporated, Canberra Commercial Development Authority, Commonwealth Accommodation and Catering Services Limited, and the Legal Aid Commission (A.C.T.), as well as the Northern Territory of Australia. The legislation applies to these entities and their employees or members who are part of approved superannuation schemes. The geographic reach of these regulations is national, applying across the Commonwealth of Australia, and they operate within the broader framework of the Superannuation Act 1976. The approved authorities must also ensure that the funds are used solely for the benefit of the employees and their dependants, and that the funds are not used for any other purpose. Breaches of the obligations and requirements under the Superannuation Act 1976 may result in civil or criminal penalties, depending on the nature and severity of the breach. For example, an approved authority that fails to maintain proper records of the funds, or that invests the funds in a manner that is not in compliance with the regulations, may be subject to a civil penalty of up to $10,500 for each contravention. In more serious cases, individuals who are involved in the management of the funds and who are found to have engaged in fraudulent or dishonest conduct may be subject to criminal penalties, including fines and imprisonment. The maximum penalties for criminal offences under the Act vary depending on the specific offence and the circumstances of the case.
