Overview

The Superannuation Act 1976 was enacted to provide a framework for the administration and regulation of superannuation schemes in Australia. This Act was designed to address the gap in the provision of a secure retirement income for employees, ensuring that they have a financial safety net after their working years. The Superannuation Act 1976 (Eligible Superannuation Schemes) Declaration No. 1 was introduced by the Commonwealth Superannuation Board of Trustees No. 2 under the authority granted by the Act. The primary policy objective of this declaration was to specify additional superannuation schemes that qualify for the benefits and protections afforded by the Superannuation Act 1976. This declaration aimed to enhance the scope of eligible superannuation schemes, thereby extending the protection and benefits to a broader range of employees. The declaration includes the AIDC Executive Superannuation Plan, the AIDC Staff Superannuation Plan, and the CAA Staff Superannuation Fund as eligible superannuation schemes under the Act, effective from 1 October 1991.

Scope and Application

The Superannuation Act 1976 (Eligible Superannuation Schemes) Declaration No. 1, made by the Commonwealth Superannuation Board of Trustees No. 2, identifies specific superannuation schemes as eligible under the Superannuation Act 1976. This declaration specifies that the AIDC Executive Superannuation Plan, the AIDC Staff Superannuation Plan, and the CAA Staff Superannuation Fund are recognised as eligible superannuation schemes for the purposes of Division 3 of Part IX of the Act. This recognition means these schemes qualify for certain benefits and obligations prescribed under the Act, which generally applies to superannuation arrangements in Australia. The declaration is applicable to these named entities and does not specify any exclusions or exemptions beyond the scope of the listed schemes. The declaration's effect took place from 1 October 1991, as per clause 5 of the determination.

Key Provisions

The Superannuation Act 1976 (Eligible Superannuation Schemes) Declaration No. 1, issued by the Commonwealth Superannuation Board of Trustees No. 2, designates specific superannuation schemes as eligible under the Superannuation Act 1976. This legislative instrument declares the AIDC Executive Superannuation Plan, the AIDC Staff Superannuation Plan, and the CAA Staff Superannuation Fund as eligible superannuation schemes (sections 4 and 5). These declarations are made to ensure that these schemes meet the criteria set out in Division 3 of Part IX of the Act, thus allowing them to benefit from the provisions of the Act. The Act imposes obligations on these superannuation schemes to ensure they comply with the conditions set out for eligibility. These conditions are designed to maintain the integrity and purpose of superannuation funds, ensuring that they provide for the retirement benefits of their members. The schemes must adhere to the specific requirements of the Superannuation Act 1976, which include maintaining adequate funding, transparent governance, and proper administration. Additionally, these schemes must be structured to provide long-term financial security for their members, in line with the objectives of the Act. Failure to comply with the provisions of the Superannuation Act 1976, or the terms of this declaration, may result in civil or criminal consequences. The Act allows for enforcement actions against trustees, administrators, and other responsible parties if the schemes do not meet their obligations. Civil penalties may include fines and other financial penalties, while criminal offences may lead to imprisonment. The exact penalties depend on the nature and severity of the breach, with the maximum penalties outlined in the Superannuation Act 1976. It is crucial for the parties involved to ensure strict compliance to avoid these repercussions.
