Overview

The Sulphate of Ammonia Bounty Regulations 1962 were established under the Sulphate of Ammonia Bounty Act 1962, to provide a structured framework for the administration of bounties on sulphate of ammonia produced within Australia. The Act was introduced to address the need for incentivising the domestic production of sulphate of ammonia, a crucial fertiliser component. Enacted by the Commonwealth of Australia, these regulations detail the processes for appointment of authorised agents, authorisations for bounty claims, and the procedures for producers to notify and apply for bounties. The policy objective is to ensure that the bounty system is efficiently administered and that producers are adequately supported in their production activities. These regulations set out specific forms and procedures for producers to follow in order to claim bounties, thereby providing clarity and a legal basis for the bounty system.

Scope and Application

The Sulphate of Ammonia Bounty Regulations 1962, made under the Sulphate of Ammonia Bounty Act 1962, apply to producers of sulphate of ammonia in Australia. These regulations govern the appointment of authorized agents, authorizations for receiving bounty, notices of intention to claim bounty, and applications for bounty. The appointment of authorized agents is specified in regulation 3, while authorizations for receiving bounty are detailed in regulation 4. Producers must give a notice of their intention to claim bounty within one month of commencing production or the date of regulation commencement, as per regulation 5. Bounty applications must be lodged with the relevant Collector of Customs within two months after the quarter in which the sulphate of ammonia was sold for use in Australia as fertilizer, with provision for extensions, as outlined in regulation 6. The regulations also include forms for the appointment of authorized agents, authorization to receive bounty, notice of intention to claim bounty, and bounty applications, which are detailed in the Schedule to the Regulations. The Sulphate of Ammonia Bounty Regulations 1962 are applicable on a national level, extending to all states and territories within Australia where sulphate of ammonia is produced and sold for use as fertilizer.

Key Provisions

The Sulphate of Ammonia Bounty Regulations, made under the Sulphate of Ammonia Bounty Act 1962, establish the framework for producers to claim bounty on sulphate of ammonia. The regulations specify various forms and processes that producers must follow to be eligible for the bounty (Regulation 2). A producer can appoint an authorized agent to execute notices, declarations, certificates, or documents on their behalf (Regulation 3). Such agents are bound by the same liabilities and penalties as the producers themselves if they execute any of these documents. Authorizations for receiving bounty must adhere to Form 2 and be submitted to the appropriate Collector of Customs (Regulation 4). Producers intending to claim bounty must notify the Collector within one month of commencing production or the commencement of these regulations, whichever is later (Regulation 5). Bounty applications must be lodged within two months after the quarter in which the sulphate of ammonia was sold for use in Australia as fertilizer, with additional time permissible at the Collector’s discretion (Regulation 6). These applications must be accompanied by a declaration from the producer or their authorized agent, confirming the accuracy and completeness of the information provided. Producers and their authorized agents face stringent obligations under these regulations. They must ensure that the sulphate of ammonia is of good and merchantable quality and produced at registered premises (Regulation 6(4)). They must also declare that no other bounty applications have been made for the same sulphate of ammonia and that no bounty or advances have been received for it. Failure to comply with these obligations may result in forfeiture of the right to the bounty. The regulations also outline specific penalties for breaches. Producers and authorized agents who provide false or misleading information in their applications or declarations commit an offence and are subject to penalties. The exact penalties are not specified within the regulations themselves but would likely be determined under the Sulphate of Ammonia Bounty Act 1962 or other relevant legislation. The seriousness of the offence could lead to both civil and criminal consequences, depending on the extent and intent of the breach.
