Overview

The Student Loans (Overseas Debtors Repayment Levy) Amendment Act 2023 was enacted by the Parliament of Australia to address the need for legislative alignment following the passage of the Trade Support Loans Amendment Act 2023. This amendment act introduces consequential changes to the Student Loans (Overseas Debtors Repayment Levy) Act 2015, ensuring that the definitions and references within the legislation are updated to reflect the changes in the Trade Support Loans Act 2014, now replaced by the Australian Apprenticeship Support Loans Act 2014. The policy objective of this amendment is to maintain consistency and accuracy within the legislative framework concerning the repayment of student loans by overseas debtors. The Act is set to commence on 1 January 2024, in alignment with the Trade Support Loans Amendment Act 2023, and will not take effect if the latter does not commence.

Scope and Application

The Student Loans (Overseas Debtors Repayment Levy) Amendment Act 2023 amends the Student Loans (Overseas Debtors Repayment Levy) Act 2015 to reflect changes made by the Trade Support Loans Amendment Act 2023. This Act applies to overseas debtors who have taken out student loans and who are required to pay a levy as part of their debt repayment obligations. The amendment specifically replaces references to the Trade Support Loans Act 2014 with the Australian Apprenticeship Support Loans Act 2014 in the definition of overseas debtors repayment levy and in section 5 of the principal Act. This legislative amendment ensures consistency and alignment between the two Acts, thereby streamlining the legislative framework governing these financial obligations. The Act has a national jurisdictional reach, applying across Australia. The commencement of this Act is tied to the Trade Support Loans Amendment Act 2023, with both Acts set to commence on 1 January 2024, provided the latter Act comes into effect. If the Trade Support Loans Amendment Act 2023 does not commence, this Act will not take effect at all.

Key Provisions

The Student Loans (Overseas Debtors Repayment Levy) Amendment Act 2023 amends the Student Loans (Overseas Debtors Repayment Levy) Act 2015. Section 1 of the Act changes the name of the Act to the Student Loans (Overseas Debtors Repayment Levy) Amendment Act 2023, while section 2 provides the commencement details, stating that the Act will commence on 1 January 2024, but only if the Trade Support Loans Amendment Act 2023 also commences. The Act includes amendments to the original legislation, which are detailed in Schedule 1. The key amendments made by this Act are found in Schedule 1 and involve the substitution of references to the Trade Support Loans Act 2014 with references to the Australian Apprenticeship Support Loans Act 2014. Specifically, in section 3, the definition of "overseas debtors repayment levy" has been modified by replacing "Trade Support Loans Act 2014" with "Australian Apprenticeship Support Loans Act 2014" in paragraph (b). Similarly, section 5 has been updated by making the same substitution. These changes reflect the consequential amendments required following the enactment of the Trade Support Loans Amendment Act 2023. Entities and individuals governed by the Student Loans (Overseas Debtors Repayment Levy) Act 2015, as amended by this Act, now need to comply with the updated references to the Australian Apprenticeship Support Loans Act 2014. This means that any obligations or requirements related to the overseas debtors repayment levy must now be interpreted in the context of the new legislative references. This includes ensuring that any levies or repayments are calculated and administered according to the provisions of the Australian Apprenticeship Support Loans Act 2014. There are no new offences, penalties, or consequences for breach introduced by this amending Act. However, non-compliance with the amended provisions of the Student Loans (Overseas Debtors Repayment Levy) Act 2015 could result in the same consequences as outlined in the original Act. These may include financial penalties or other enforcement actions taken by the relevant authorities. The exact nature and severity of these consequences would depend on the specific circumstances of the non-compliance and the provisions of the original Act as it now stands, amended by this Act.
