Overview

The Student Assistance Regulations 1978 were made under the authority of the Student Assistance Act 1973 by the Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council. These regulations address the administration of student assistance grants by providing detailed rules and procedures to implement the provisions of the Act. The primary objective of these regulations is to ensure that student assistance is provided in a timely and efficient manner, addressing issues related to application deadlines and the consideration of late applications due to circumstances beyond the applicant's control. This regulatory framework helps maintain the integrity and effectiveness of the student assistance system by setting clear guidelines for the processing and assessment of applications.

Scope and Application

The Student Assistance Regulations, made under the Student Assistance Act 1973, provide specific rules governing the application of student assistance provisions, including time limits for applications and the acceptance of late applications under certain circumstances. These regulations apply to students or prospective students who are seeking tertiary education assistance, and they are particularly pertinent to those attending or residing in the State of New South Wales or the Australian Capital Territory. The regulations establish deadlines for submitting applications and notifications, with extensions granted for certain time periods, such as the period immediately following the March 31st deadline, and specific allowances for short courses. Additionally, the regulations allow for exceptions to the time limits for applications in cases where the applicant has taken reasonable steps to submit their application on time but fails to do so due to circumstances beyond their control, or where they are unable to take such steps due to uncontrollable circumstances, provided they act as soon as practicable once those circumstances cease to apply. These amendments apply to grants of Tertiary Education Assistance for periods commencing on or after January 1, 1978, and January 1, 1979, respectively, for the specific changes introduced by the regulations.

Key Provisions

The Student Assistance Regulations (1978) under the Student Assistance Act 1973 outline specific rules regarding the timing and conditions for applications for tertiary education assistance. Regulation 45 has been amended to extend the deadline for applications in certain circumstances. For example, if an application is received after 31 March in the relevant year but before 4 weeks after the commencement of the period specified in the regulations, the late application provisions do not apply (Regulation 45(6)). Similarly, if written notification is received under certain conditions after 31 March but before the specified period, the late application provisions are waived (Regulation 45(7)). For students in New South Wales or the Australian Capital Territory, these deadlines are extended to 14 April for general applications and 15 April for short courses (Regulations 45(7)(c) and 45b(5)). The Regulations impose several obligations on applicants seeking tertiary education assistance. They must ensure their applications or written notifications are submitted within the specified timeframes, unless circumstances beyond their control prevent them from doing so. If applicants have taken reasonable steps to meet the deadlines but fail due to uncontrollable factors, they must notify the relevant authority as soon as practicable once those factors are resolved (Regulation 45ba(2)). Additionally, applicants must provide all necessary documentation and information accurately and in a timely manner to avoid any delays or denials of assistance. Failure to comply with the provisions of these Regulations can result in penalties. While specific penalties are not detailed in the provided text, breaches of the regulations could potentially lead to the denial of assistance or other administrative consequences. It is important for applicants to be aware of these obligations and the importance of adhering to the stipulated deadlines to ensure they are eligible for the assistance they seek.
