Overview

The Student Assistance Regulations 1980, made under the Student Assistance Act 1973, were enacted to provide detailed administrative provisions for the implementation of the Act, which aims to provide financial assistance to students undertaking approved courses of study. The regulations were issued by the Governor-General acting on the advice of the Federal Executive Council. The policy objective of these regulations is to ensure that the administrative processes for student assistance are efficient and accessible, while maintaining the integrity of the assistance programs. The 1980 amendments to the regulations specifically aimed to modify the application process to accommodate cases where parents are unable to sign the application due to illness or other circumstances, and to update the eligibility criteria for certain courses. The Student Assistance Regulations 1980 outline various administrative requirements for students seeking financial assistance, including the necessary documentation and eligibility criteria. The amendments made in 1980 introduced flexibility in the application process by allowing separate documentary evidence of a parent’s income when a parent cannot sign the application due to illness or absence. Additionally, the amendments updated the list of eligible courses for assistance, reflecting changes in educational offerings and ensuring that financial support is available to students in approved programs. These regulatory updates were designed to address practical challenges faced by students and their families while ensuring the continued effectiveness of the student assistance framework.

Scope and Application

The Student Assistance Regulations, made under the authority of the Student Assistance Act 1973, outline the criteria and processes for the application and provision of student assistance in Australia. These regulations apply to students and their parents, particularly focusing on the submission of applications and income information necessary to determine eligibility for assistance. The regulations have a national scope, impacting students across all states and territories, and are administered through the Commonwealth. The application of these regulations can be extended or altered through subordinate instruments, allowing for adjustments to eligibility criteria and application procedures as necessary. Notably, the regulations stipulate conditions under which parental signatures on applications may be waived, such as due to illness or incapacity, and provide for specific courses of study that qualify for assistance, such as the Diploma of Music and the Diploma of Dance Education. Certain entities, like The Australian College of Physical Education, are excluded from the schedule of eligible institutions, reflecting the targeted nature of the assistance provided.

Key Provisions

The regulations amend the Student Assistance Regulations in several key areas. Firstly, Regulation 32 is updated to require parents to provide their gross annual income as part of the application process (sub-regulation (2)(b)). However, if a parent is unable to sign the application due to illness, incapacity, or prolonged absence, or if separate documentary evidence of their income is provided, the application need not be signed by the parent (sub-regulation (4)). Secondly, Regulation 34 changes the eligibility criteria for students proposing to undertake specific courses, namely the first year of a four-year Diploma of Music at the MCLBA Memorial Conservatorium of Music in Victoria or the first year of a two-year Diploma of Dance Education at the Graduate College of Dance in Western Australia (sub-regulation (1)(a)). Thirdly, Schedule 1 is amended to remove "The Australian College of Physical Education" from the list of eligible institutions (Schedule 1). These regulations impose specific obligations on applicants and their parents. Applicants must ensure that their applications are complete, including the provision of their own and their parents' gross annual income where required. If a parent is unable to sign the application due to specified reasons, applicants must provide separate documentary evidence of that parent's income. Furthermore, applicants must ensure they are eligible based on the updated criteria for the specified courses and institutions. There are no explicit offences or penalties mentioned in the regulations themselves. However, any breach of the conditions for receiving student assistance under the Student Assistance Act 1973 could potentially result in civil or criminal consequences, such as repayment of assistance received or other legal actions. The penalties for such breaches would be determined under the relevant sections of the Student Assistance Act 1973, which are not detailed in the regulations.
