Overview

The States Grants (Youth Employment) Act 1937 was enacted to address the economic challenges faced by youth during the Great Depression by providing financial assistance to the states for the purpose of creating employment opportunities and training for young people. The Act was enacted by the Parliament of the Commonwealth of Australia and received assent on 16th September, 1937. The primary objective of the Act was to allocate a total of £200,000 from the Consolidated Revenue Fund to support youth employment initiatives across various states, with specific amounts designated for New South Wales, Victoria, Queensland, South Australia, Western Australia, and Tasmania. This funding was intended to be used in accordance with the conditions set by the Minister, to provide training and employment opportunities for individuals aged between eighteen and twenty-five years.

Scope and Application

The States Grants (Youth Employment) Act 1937 establishes a financial assistance framework intended to support states in providing vocational training and employment opportunities for young people aged between eighteen and twenty-five. The Act appropriates a sum of £200,000 from the Consolidated Revenue Fund, which is then allocated to individual states according to a specified schedule. Each state is bound by the condition that the grant must be used for the approved purpose of facilitating the training and employment of the targeted age group. Payment to the states is subject to the Treasurer's approval regarding the timing and method of disbursement. While the Act primarily outlines the financial support and its allocation, the actual implementation and conditions of the grant are subject to the Minister's discretion, allowing for flexibility in how the funds are utilised within the scope of youth employment initiatives.

Key Provisions

The States Grants (Youth Employment) Act 1937 primarily serves to allocate financial assistance from the Consolidated Revenue Fund to various states for specific purposes. Under Section 1, the Act is cited as the States Grants (Youth Employment) Act 1937. Section 2 stipulates the appropriation of Two hundred thousand pounds from the Consolidated Revenue Fund for financial assistance to the states. The allocation of this grant among the states is detailed in Section 3, with New South Wales receiving £79,000, Victoria £55,000, Queensland £25,000, South Australia £19,000, Western Australia £14,000, and Tasmania £8,000. Section 4 sets the condition that the grants must be used for the training and employment of individuals aged between eighteen and twenty-five years, subject to approval by the Minister. Finally, Section 5 outlines the method of payment, which is to be determined by the Treasurer. The Act imposes specific obligations on the states that receive the grant. The primary obligation is to use the funds solely for the purposes of training and employment of young people aged between eighteen and twenty-five years, as outlined in Section 4. This condition necessitates that the states must adhere to the approval process set by the Minister, ensuring that the funds are used effectively and efficiently towards the designated purpose. Additionally, the method of payment, which is subject to the Treasurer's approval as stated in Section 5, ensures that the disbursement of funds is managed in a manner compliant with financial and administrative regulations. Breaches of the conditions outlined in the Act may result in civil or criminal consequences, although the Act itself does not explicitly detail the specific offences, penalties, or consequences for non-compliance. However, given the nature of the legislation and the potential misuse of public funds, non-compliance could lead to legal actions under broader financial and administrative laws. The consequences could include financial penalties, audits, and possibly legal proceedings to recover misused funds or to enforce compliance with the Act's provisions. The maximum penalties for such breaches would depend on the specific laws and regulations under which the proceedings are brought.
