An Act to amend the States Grants (Tertiary Education Assistance) Act 1981
and the States Grants (Tertiary Education Assistance) Act 1978, and for
related purposes

  BE IT ENACTED by the Queen, and the Senate and the House of Representatives
of the Commonwealth of Australia, as follows:

                              PART I-PRELIMINARY
Short title

  1. This Act may be cited as the States Grants (Tertiary Education
Assistance) Legislation Amendment Act 1982.


STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) LEGISLATION AMENDMENT ACT 1982 No. 27, 1982 - SECT. 2.
Commencement


SECT

  2. (1) Subject to sub-section (2), this Act shall come into operation on the
day on which it receives the Royal Assent.

  (2) Sections 5 and 6 shall be deemed to have come into operation on 26
November 1981.

STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) LEGISLATION AMENDMENT ACT 1982 No. 27, 1982 - SECT. 4.
Research centres of excellence

  4. Section 9 of the Principal Act is amended by omitting from sub-section
(4) ''$16,000,000'' and substituting ''$14,800,000''.

Interpretation


SECT

  5. Section 14 of the Principal Act is amended by adding at the end of
paragraph (c) of the definition of ''college purposes'' in sub-section (1) '',
whichever is the lesser amount''.

  7. Section 23 of the Principal Act is amended by omitting from
sub-sub-paragraph (3) (b) (iii) (A) ''than'' and substituting ''that''.

Grants for community language courses

  8. Section 38 of the Principal Act is amended by omitting from sub-section
(4) ''$900,000'' and substituting ''$820,000''.

Substitution of Schedules

  9. (1) Schedule 1 to the Principal Act is repealed and the Schedule set out
in Schedule 1 to this Act is substituted.

  (2) Schedule 2A to the Principal Act is repealed and the Schedule set out in
Schedule 2 to this Act is substituted.

  (3) Schedule 4 to the Principal Act is repealed and the Schedule set out in
Schedule 3 to this Act is substituted.

  (4) Part II of Schedule 7 to the Principal Act is repealed and the Part set
out in Schedule 4 to this Act is substituted.

  (5) Part V of Schedule 7 to the Principal Act is repealed and the Part set
out in Schedule 5 to this Act is substituted.

  (6) Schedules 8 and 9 to the Principal Act are repealed and the Schedules
set out in Schedule 6 to this Act are substituted.

Certain directions to cease to have effect

  10. A direction given on or before 28 February 1982 by the Minister under
sub-section 7 (6) or (8), 17 (3), (4), (5), (9) or (10), 18 (1) or 39 (1) of
the Principal Act or by the Commonwealth Tertiary Education Commission under
sub-section 7 (5) or (7), 17 (1), (2), (7) or (8) or 18 (2) of that Act shall,
by force of this section, cease to have effect upon the commencement of this
section, but this section shall not be taken to affect the previous operation
of the direction.

Payments made before Royal Assent


SECT

  11. Payments (including advances) by way of financial assistance made to a
State or to the Northern Territory under the Principal Act shall be deemed to
have been made for the purposes of the Principal Act as amended by this Act.

Transitional


SECT

  12. For all purposes of the States Grants (Tertiary Education Assistance)
Act 1981, as in force either before or after the commencement of this
section-

  (a)  the Catholic College of Education, Sydney shall be deemed to have been,
and to be, the same body as the Combined Catholic College; and

  (b) The Phillip Institute of Technology shall be deemed to have been, and to
be, the same body as the Amalgamated Preston Institute of Technology/Coburg.

  PART III-AMENDMENTS OF THE STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) ACT 1978

  13. The States Grants (Tertiary Education Assistance) Act 1978*2* is in this
Part referred to as the Principal Act.


STATES GRANTS (TERTIARY EDUCATION ASSISTANCE) LEGISLATION AMENDMENT ACT 1982 No. 27, 1982 - SECT. 14.
Recurrent grants in respect of student residences and affiliated colleges of
Universities

  14. Section 9 of the Principal Act is amended-

  (a)  by omitting sub-sections (2A) and (2B) and substituting the following
sub-sections:

     ''(2A) In relation to each student residence of a University, there is
payable to the State in which the University is situated, in respect of the
year 1980-

     (a)  an amount equal to the sum of $11,057 and the amount ascertained by
multiplying $172.48 by the prescribed number of students for that year in
relation to that student residence; or

     (b)  an amount ascertained by multiplying $390.67 by the prescribed
number of students for that year in relation to that student residence,

    whichever is the lesser amount.

     ''(2B) In relation to each student residence of a University, there is
payable to the State in which the University is situated, in respect of the
year 1981-

     (a)  an amount equal to the sum of $12,726 and the amount ascertained by
multiplying $198.52 by the prescribed number of students for that year in
relation to that student residence; or

     (b)  an amount ascertained by multiplying $449.67 by the prescribed
number of students for that year in relation to that student residence,

    whichever is the lesser amount''; and

  (b)  by omitting sub-sections (4A) and (4B) and substituting the following
sub-sections:

     ''(4A) For the purposes of sub-section (3), the basic grant in respect of
an affiliated college for the year 1980 is-

     (a)  if the prescribed number of students for that year in relation to
that college is less than 50-$390.67;

     (b)  if the prescribed number of students for that year in relation to
that college is more than 49 but less than 75-$390.67 reduced by $2.95 for
each student by which the prescribed number of students exceeds 50;

     (c)  if the prescribed number of students for that year in relation to
that college is more than 74 but less than 100-$316.95 reduced by $1.47 for
each student by which the prescribed number of students exceeds 75; or

     (d)  if the prescribed number of students for that year in relation to
that college is more than 99-$280.12 reduced by $0.23 for each student by
which the prescribed number of students exceeds 100.

     ''(4B) For the purposes of sub-section (3), the basic grant in respect of
an affiliated college for the year 1981 is-

     (a)  if the prescribed number of students for that year in relation to
that college is less than 50-$449.67;

     (b)  if the prescribed number of students for that year in relation to
that college is more than 49 but less than 75-$449.67 reduced by $3.39 for
each student by which the prescribed number of students exceeds 50;

     (c)  if the prescribed number of students for that year in relation to
that college is more than 74 but less than 100-$364.82 reduced by $1.70 for
each student by which the prescribed number of students exceeds 75; or

     (d)  if the prescribed number of students for that year in relation to
that college is more than 99-$322.42 reduced by $0.26 for each student by
which the prescribed number of students exceeds 100.''.

Grants for recurrent expenditure in Northern Territory on advanced education

  15. Section 15B of the Principal Act is amended by omitting from paragraph
(2) (d) ''(7) (a) (ii)'' and substituting ''(8) (a) (ii)''.

Recurrent grants in respect of student residences and affiliated colleges of
colleges of advanced education

  16. Section 17 of the Principal Act is amended-

  (a)  by omitting sub-sections (2A) and (2B) and substituting the following
sub-sections:

     ''(2A) In relation to each college of advanced education providing
collegiate accommodation at a student residence or at student residences,
there is payable to the State in which the college is situated, in respect of
the year 1980-

     (a)  an amount equal to the sum of $11,057 and the amount ascertained by
multiplying $172.48 by the number of resident full-time students at the
student residence or at the student residences, as the case may be, in that
year; or

     (b)  an amount ascertained by multiplying $390.67 by the number of
resident full-time students at the student residence or at the student
residences, as the case may be, in that year,

    whichever is the lesser amount.

     ''(2B) In relation to each college of advanced education providing

  (a)  by omitting from paragraph (2) (a) ''$1,362,000'' and substituting
''$1,366,000''; and

Grants in respect of contributions to National Institute of Dramatic Art

  18. Section 20 of the Principal Act is amended-

  (a)  by omitting from paragraph (1A) (b) ''$567,500'' and substituting
''$569,500''; and

  (b)  by omitting from paragraph (1A) (c) ''$635,500'' and substituting
''$657,500''.

  19. Section 30E of the Principal Act is amended-

  (a)  by omitting from sub-section (8) ''$885,000'' and substituting
''$866,000''; and

  (b)  by omitting from sub-section (8A) ''$1,664,000'' and substituting
''$1,645,000''.

  (2) Schedule 6 to the Principal Act is repealed and the Schedule set out in

  (3) Parts I to IV (inclusive) of Schedule 8 to the Principal Act are
repealed and the Parts set out in Schedule 9 to this Act are substituted.

  (4) Schedule 8A to the Principal Act is repealed and the Schedule set out in
Schedule 10 to this Act is substituted.

  (5) Schedule 10 to the Principal Act is repealed and the Schedule set out in
Schedule 11 to this Act is substituted.

  (6) Parts II, III and IV of Schedule 11 to the Principal Act are repealed
and the Parts set out in Schedule 12 to this Act are substituted.

  (7) Schedules 12 and 13 to the Principal Act are repealed and the Schedules
set out in Schedule 13 to this Act are substituted.

  (8) Schedule 15 to the Principal Act is repealed and the Schedule set out in
Schedule 14 to this Act is substituted.
