An Act to amend the States Grants (Tertiary Education Assistance) Act 1981, and for related purposes

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:

Short title, &c.

1. (1) This Act may be cited as the States Grants (Tertiary Education Assistance) Amendment Act 1983.

(2) The States Grants (Tertiary Education Assistance) Act 19811 is in this Act referred to as the Principal Act.

Commencement

2. This Act shall come into operation on the day on which it receives the Royal Assent.

Approval of, and directions relating to, building projects

3. Section 4 of the Principal Act is amended—

(a) by omitting from sub-section (2) “and 7a” and substituting “, 7a and 7b”; and

(b) by omitting from sub-section (5) “or Schedule 7a” and substituting “, Schedule 7a or Schedule 7b”.

Research centres of excellence

4. Section 9 of the Principal Act is amended by omitting from sub-section (4) “$14,800,000” and substituting “$14,300,000”.

Grants for equipment

5. Section 10 of the Principal Act is amended by omitting from sub-section (7) “or the year 1983” and substituting “, the year 1983 or the year 1984”.

Recurrent grants in respect of student residences and affiliated colleges

6. Section 11 of the Principal Act is amended—

(a) by omitting from paragraph (3) (b) “$4,490,000” and substituting “$4,450,000”; and

(b) by omitting from paragraph (3) (c) “$4,490,000” and substituting “$3,480,000”.

7. After section 13a of the Principal Act the following section is inserted in Part II:

Building projects in respect of the year 1984

“13b. (1) Subject to sub-section (3), in relation to each building project specified, in relation to a university, in Column 2 of Part I of Schedule 7b, there is payable to the State in which the university is situated, for the purpose of financial assistance in relation to the building project in respect of the year 1984, the amount specified in Column 4 of that Part of that Schedule in relation to the description of the project in Column 2.

“(2) The Commission may approve a minor building project submitted to it by a university as an approved minor building project of the university in respect of the year 1984 and, where it does so, it shall also approve an amount, being an amount equal to the estimated cost of the project, as the approved cost of the project and an amount as the amount of the approved expenditure on the project in respect of the year 1984.

“(3) Subject to sub-section (4), where the Commission approves, under sub-section (2), a minor building project of a university in respect of the year 1984, there is payable to the State in which the university is situated, for the purpose of financial assistance in relation to the project in respect of the year 1984, an amount equal to the amount of the approved expenditure on the project in respect of the year 1984.

“(4) The total of the amounts payable to a State under sub-section (3), in relation to a university specified in Column 1 of Part II of Schedule 7b, shall not exceed the amount specified in Column 2 of that Part of that Schedule in relation to the university.

“(5) The Commission may approve an amount as the amount of the approved expenditure in respect of the year 1984 on a design project of a university specified in Part III of Schedule 7b.

“(6) Subject to sub-section (7), where the Commission approves an amount as the amount of the approved expenditure, in respect of the year 1984, on a design project of a university specified in Part III of Schedule 7b, there is payable to the State in which the university is situated, for the purpose of financial assistance in relation to the project in respect of the year 1984, an amount equal to the amount of that approved expenditure.

“(7) The total of the amounts payable to all the States under sub-section (6) shall not exceed the amount set out in Part III of Schedule 7b as the total of the grants payable in respect of design projects specified in that Part.

“(8) The Commission may revoke or vary an approval given under sub-section (2) or (5) and, if it varies the amount of the approved expenditure on a project in respect of the year 1984, then, for the purposes of this Act, the amount as so varied shall be deemed—

(a) in the case of a project approved under sub-section (2)—as from the date on which the project was so approved; or

(b) in the case of a design project specified in Part III of Schedule 7b—as from the date on which an approval was given under sub-section (5) in respect of the project,

to have been the amount of the approved expenditure on the project in respect of the year 1984.

“(9) Where the amount expended in relation to work carried out before 1 January 1984 in connection with a building project that is specified in relation to a university in Column 2 of Part I of Schedule 7a exceeds the sum of the amounts paid to the State in which the university is situated, before 1 January 1984, in relation to the project under this Act or under any previous Act that granted financial assistance to the States in relation to universities, the Minister may, if an amount is specified in Part I of Schedule 7b to this Act in relation to that project, at the request of the State made to him not later than 30 September 1984, direct that an amount specified in the direction, being an amount that does not exceed the amount of the excess, shall be treated as if it had been expended in relation to work carried out in connection with the project in the year 1984 and, where the Minister gives such a direction, then, for the purposes of this Act, that amount shall be treated as if it had been so expended in the year 1984.”.

Grants for equipment

8. Section 19 of the Principal Act is amended by omitting from sub-section (6) “or the year 1983” and substituting “, the year 1983 or the year 1984”.

Recurrent grants in respect of student residences and affiliated colleges

9. Section 20 of the Principal Act is amended—

(a) by omitting from paragraph (3) (b) “$1,372,000” and substituting “$1,358,000”;

(b) by omitting from paragraph (3) (c) “$1,372,000” and substituting “$1,064,000”; and

10. After section 21a of the Principal Act the following section is inserted:

Building projects in respect of the year 1984

“21b. (1) In relation to each building project specified, in relation to a college of advanced education, in Column 2 of Part IV of Schedule 7b, there is payable to the State in which the college is situated, for the purpose of financial assistance in relation to the building project in respect of the year 1984, the amount specified in Column 4 of that Part of that Schedule in relation to the description of the project in Column 2.

“(2) The Commission may approve a minor building project submitted to it by a State as an approved minor building project of a college of advanced education in respect of the year 1984, and, if it approves such a project, it shall also approve an amount, being an amount equal to the estimated cost of the project, as the approved cost of the project and an amount as the amount of the approved expenditure on the project in respect of the year 1984.

“(3) Subject to sub-section (4), where the Commission approves a minor building project of a college of advanced education under sub-section (2), there is payable to the State in which the college is situated, for the purpose of financial assistance in relation to the project in respect of the year 1984, an amount equal to the amount of the approved expenditure on the project in respect of the year 1984.

“(4) The total of the amounts payable to a State under sub-section (3) in relation to minor building projects of colleges of advanced education situated in the State shall not exceed the amount specified in Column 2 of Part V of Schedule 7b in relation to the State.

“(5) The Commission may revoke or vary an approval given by it under sub-section (2) and, if it varies the amount of the approved expenditure on a project in respect of the year 1984, then, for the purposes of this Act (including this section), the amount so varied shall be deemed to have been, as from the date on which the project was so approved under sub-section (2), the amount of the approved expenditure on the project in respect of the year 1984.

“(6) Where the amount expended in relation to work carried out before 1 January 1984 in connection with a building project that is specified in relation to a college of advanced education in Column 2 of Part IV of Schedule 7a exceeds the sum of the amounts paid to the State in which the college of

advanced education is situated, before 1 January 1984, in relation to the project under this Act or under any previous Act that granted financial assistance to the States in relation to colleges of advanced education, the Minister may, if an amount is specified in Part iv of Schedule 7b to this Act in relation to that project, at the request of the State made to him not later than 30 September 1984, direct that an amount specified in the direction, being an amount that does not exceed the amount of the excess, shall be treated as if it had been expended in relation to work carried out in connection with the project in the year 1984 and, where the Minister gives such a direction, then, for the purposes of this Act, that amount shall be treated as if it had been so expended in the year 1984.”.

Grants for courses of teacher education provided by non-government teachers colleges

11. Section 23 of the Principal Act is amended—

(a) by omitting sub-paragraphs (2) (a) (ii) and (iii) and substituting the following sub-paragraphs:

“(ii) in respect of the year 1983—$958,000; or

(iii) in respect of the year 1984—$1,001,000; or”; and

(b) by omitting sub-paragraphs (2) (b) (ii) and (iii) and substituting the following sub-paragraphs:

“(ii) in respect of the year 1983—$1,303,000; or

(iii) in respect of the year 1984—$1,476,000.”.

Grants for equipment for non-government teachers colleges

12. Section 24 of the Principal Act is amended—

(a) by omitting from paragraph (4) (a) “or”;

(b) by adding at the end of sub-section (4) the following word and paragraph:

“; or (c) in the case of the year 1984—$84,000.”; and

Grants for minor building projects of non-government teachers colleges

13. Section 25 of the Principal Act is amended—

(a) by omitting from paragraph (3) (a) “or”;

(b) by adding at the end of sub-section (3) the following word and paragraph:

“; or (c) in the case of the year 1984—$44,000”; and

Interpretation

14. Section 27 of the Principal Act is amended by omitting “or the year 1983” from the definition of “year to which this Part applies” and substituting “, the year 1983 or the year 1984”.

Proposals for expenditure on staff training, data collection and processing and advanced English language courses for migrants

15. Section 29 of the Principal Act is amended—

(a) by omitting “or” from the end of paragraph (1) (a);

(b) by inserting after paragraph (1) (b) the following word and paragraph:

“; or (c) the development and provision for adult migrants of advanced courses of instruction in the English language.”;

“(b) if it does so, shall—

(i) where the approval relates to a proposal for expenditure in connection with a program referred to in paragraph (1) (a), designate the approval as an approval of the proposal for the purposes of sub-section (5) or (6);

(ii) where the approval relates to a proposal for expenditure in connection with a program referred to in paragraph (1) (b), designate the approval as an approval of the proposal for the purposes of sub-section (7) or (7a); or

(iii) where the approval relates to a proposal for expenditure in connection with a program referred to in paragraph (1) (c), designate the approval as an approval of the proposal for the purposes of sub-section (7b) or (7c); and”;

(d) by omitting from paragraph (4) (a) “or”;

(e) by adding at the end of sub-section (4) the following word and paragraph:

“; or (c) in the case of the year 1984—in Part VI of Schedule 12.”;

(f) by inserting after sub-section (4) the following sub-sections:

“(4a) Subject to sub-section (4b), where the Commission approves a proposal in respect of the year 1984 for the purposes of sub-section (7a), it shall approve an amount as the amount of approved expenditure of that proposal in respect of that year.

“(4b) The aggregate of the amounts approved by the Commission under sub-section (4a) as amounts of approved expenditure on proposals approved for the purposes of sub-section (7a) in respect of

the year 1984 shall not exceed the amount specified in Part VII of Schedule 12.

“(4c) Subject to sub-section (4d), where the Commission approves a proposal in respect of the year 1984 for the purposes of sub-section (7c), it shall approve an amount as the amount of approved expenditure of that proposal in respect of that year.

“(4d) The aggregate of the amounts approved by the Commission under sub-section (4c) as amounts of approved expenditure on proposals approved for the purposes of sub-section (7c) in respect of the year 1984 shall not exceed the amount specified in Part VIII of Schedule 12.”;

(g) by omitting from paragraph (5) (a) “or”;

(h) by adding at the end of sub-section (5) the following word and paragraph:

“; or (c) in the case of the year 1984—in Column 2 of Part V of Schedule 12.”;

(j) by omitting from paragraph (7) (a) “or”;

(k) by inserting after “paragraph (1) (b)” in sub-section (7) “(not being a proposal or proposals approved for the purposes of sub-section (7a))”;

(m) by adding at the end of sub-section (7) the following word and paragraph:

“; or (c) in the case of the year 1984—in Column 3 of Part V of Schedule 12.”;

(n) by inserting after sub-section (7) the following sub-sections:

“(7a) There is payable to a State, for the purpose of financial assistance in respect of expenditure incurred or to be incurred by the State or by an instrumentality of the State in relation to a proposal in respect of the year 1984 approved for the purposes of this sub-section, an amount equal to the amount of the approved expenditure on the proposal in respect of that year.

“(7b) There is payable to a State, for the purpose of financial assistance in respect of expenditure incurred or to be incurred by the State or by an instrumentality of the State in accordance with an approved proposal or approved proposals for expenditure by the State in respect of the year 1984 in connection with a program or programs referred to in paragraph (1) (c) (not being a proposal or proposals approved for the purposes of sub-section (7c)), the amount specified in relation to the State in Column 4 of Part V of Schedule 12.

“(7c) There is payable to a State, for the purpose of financial assistance in respect of expenditure incurred or to be incurred by the State or by an instrumentality of the State in relation to a proposal in respect of the year 1984 approved for the purposes of this sub-section

an amount equal to the amount of the approved expenditure on the proposal in respect of that year.”; and

(p) by adding at the end thereof the following sub-sections:

“(11) Financial assistance is granted to a State under sub-section (7a) on the conditions that—

(a) the State will ensure that the total of the amounts expended in respect of the year 1984 by the State and by instrumentalities of the State in accordance with proposals for expenditure by the State in respect of that year approved for the purpose of sub-section (7a) is not less than the sum of the amounts of financial assistance paid to the State under that sub-section in respect of that year; and

(b) the State will furnish to the Commission, not later than 30 September 1985, a statement by an approved auditor, in accordance with a form approved by the Commission, as to the expenditure by the State and by instrumentalities of the State in accordance with such approved proposals for expenditure.

“(12) Financial assistance is granted to a State under sub-section (7b) on the conditions that—

(a) the State will ensure that the total of the amounts expended in respect of the year 1984 by the State and by instrumentalities of the State in accordance with approved proposals for expenditure by the State in respect of that year in connection with programs referred to in paragraph (1) (c) is not less than the sum of the amounts of financial assistance paid to the State under sub-section (7b) in respect of that year; and

“(13) Financial assistance is granted to a State under sub-section (7c) on the conditions that—

(a) the State will ensure that the total of the amounts expended in respect of the year 1984 by the State and by instrumentalities of the State in accordance with proposals for expenditure by the State in respect of that year approved for the purpose of sub-section (7c) is not less than the sum of the amounts of financial assistance paid to the State under that sub-section in respect of that year; and

(b) the State will furnish to the Commission, not later than 30 September 1985, a statement by an approved auditor, in

accordance with a form approved by the Commission, as to the expenditure by the State and by instrumentalities of the State in accordance with such approved proposals or expenditure.”.

Variations of amounts in Schedule 12

16. Section 30 of the Principal Act is amended—

(a) by omitting from sub-sections (1) and (2) “I and III” and substituting “I, III and V”;

(b) by omitting from sub-sections (3) and (4) “Part I or Part III” (wherever occurring) and substituting “Part I, Part III or Part V”;

(d) by adding at the end of sub-section (5) the following word and paragraph:

“; and (c) in the case of the year 1984—to 1 January 1984.”.

Other recurrent grants

17. Section 31 of the Principal Act is amended—

(a) by adding “and” at the end of paragraph (1) (d);

(b) by omitting “and” from the end of paragraph (1) (e);

(d) by omitting from sub-section (4) “II and IV” and substituting “II, IV and VI”; and

(e) by omitting from sub-section (5) “I and III” and substituting “I, III and V”.

Building projects in respect of the year 1983

18. (1) Section 34a of the Principal Act is amended by omitting from sub-section (2) “Part VII” and substituting “Part VI”.

(2) The amendment made by sub-section (1) shall be deemed to have taken effect on 14 December 1982.

19. After section 34a of the Principal Act the following section is inserted in Part IV:

Building projects in respect of the year 1984

“34b. (1) In relation to each building project specified, in relation to a technical and further education institution, in Column 2 of Part VI of Schedule 7b, there is payable to the State in which the institution is situated, for the purpose of financial assistance in relation to the project in respect of the year 1984, the amount specified in Column 4 of that Schedule in relation to the description of the project in Column 2.

“(2) Where the amount expended in relation to work carried out before 1 January 1984 in connection with a building project that is specified in relation to a technical and further education institution in Column 2 of Part VI of Schedule 7a exceeds the sum of the amounts paid to the State in which the

technical and further education institution is situated, before 1 January 1984, in relation to the project under this Act or under any previous Act that granted financial assistance to the States in relation to technical and further education institutions, the Minister may, if an amount is specified in Part VI of Schedule 7b to this Act in relation to that project, at the request of the State made to the Minister not later than 30 September 1984, direct that an amount specified in the direction, being an amount that does not exceed the amount of the excess, shall be treated as if it had been expended in relation to work carried out in connection with the project in the year 1984 and, where the Minister gives such a direction, then, for the purposes of this Act, that amount shall be treated as if it had been so expended in the year 1984.”.

Grants for community language courses

20. Section 38 of the Principal Act is amended by omitting paragraphs (4) (b) and (c) and substituting the following paragraphs:

“(b) in respect of the year 1983—$894,000; or

Recurrent grants may be increased to assist institutions in meeting certain superannuation expenses

21. Section 38a of the Principal Act is amended by omitting paragraph (3) (b) and substituting the following paragraph:

“(b) in respect of the year 1984—$9,110,000.”.

22. After section 38a of the Principal Act the following section is inserted:

Recurrent grants may be increased to assist institutions in meeting expenses due to increased enrolments in 1984

“38b. (1) Where, after receiving advice from the Commission, the Minister is satisfied that a university or college of advanced education has incurred, or will incur, in respect of the year 1984, additional expenditure by reason of the increased numbers of students enrolling at the university or college of advanced education or by reason of special measures to encourage increased numbers of students, the Minister may determine an amount of additional financial assistance that is to be payable in relation to that university or that college of advanced education and, upon the making of that determination, this Act has effect as if—

(a) in a case where the amount is determined in relation to a university—the amount specified opposite to the name of that university in the Column of Schedule 1 that relates to that year had been increased (as from 1 January in that year) by the amount so determined; or

(b) in a case where the amount is determined in relation to a college of advanced education—the amount specified opposite to the name of that college in the Column of Part I of Schedule 8 that relates to that year had been increased (as from 1 January in that year) by the amount so determined.

“(2) The aggregate of the amounts determined under sub-section (1) in relation to universities and colleges of advanced education shall not exceed $10,470,000.

“(3) As soon as practicable after the Minister has made a determination under sub-section (1), the Minister shall cause a statement setting out particulars of the determination to be laid before each House of the Parliament.”.

Repeal of sections 39 and 39a

23. Sections 39 and 39a of the Principal Act are repealed.

Conditions attaching to building grants

24. Section 40 of the Principal Act is amended—

(a) by omitting from sub-section (1) “21, 21a, 34 or 34a” and substituting “13b, 21, 21a, 21b, 34, 34a or 34b”;

(b) by inserting after paragraph (2) (aa) the following paragraph:

“(ab) in a case where the tertiary education institution is a university and that year is 1984—

(i) a building project specified in Column 2 of Part I of Schedule 7b in relation to the university;

(ii) a project approved by the Commission under sub-section 13b (2) as an approved minor building project of the university in respect of that year; or

(iii) a design project of the university specified in Part III of Schedule 7b;”;

“(bb) in a case where the tertiary education institution is a college of advanced education and the year is 1984—

(i) a project specified in Column 2 of Part IV of Schedule 7b in relation to the college; or

(ii) a project approved by the Commission under sub-section 21b (2) as an approved minor building project of the college in respect of that year;”; and

(d) by inserting after paragraph (2) (d) the following paragraph:

“(da) in a case where the tertiary education institution is a technical and further education institution and the year is 1984—a project specified in Column 2 of Part VI of Schedule 7b in relation to the technical and further education institution.”.

Variations of building grants in Schedule 7, 7a or 7b

25. Section 41 of the Principal Act is amended—

(a) by omitting from sub-section (3) “or the year 1983” and substituting “, the year 1983 or the year 1984”;

(b) by omitting from sub-sections (4) and (6) “21, 21a, 34 or 34a” and substituting “13b, 21, 21a, 21b, 34, 34a or 34b”;

“(aa) that would result in the aggregate of the amounts payable to the States under sections 13a, 21a and 34a being greater or less than $157,300,000;

(ab) that would result in the aggregate of the amounts payable to the States under sections 13b, 21b and 34b being greater or less than $173,283,000; or”;

(d) by omitting “or” from paragraph (a) of the definition of “commencing day” in sub-section (11);

(e) by inserting after paragraph (b) of the definition of “commencing day” in sub-section (11) the following word and paragraph:

“or (c) in relation to a variation of Schedule 7b—the day on which the States Grants (Tertiary Education Assistance) Amendment Act 1983 received the Royal Assent;”; and

(f) by omitting from the definition of “relevant Schedule” in sub-section (11) “or Schedule 7a” and substituting “, Schedule 7a or Schedule 7b”.

26. After section 41 of the Principal Act the following section is inserted:

Benefits of, and opportunities created by, grants to be equally available to male students and female students

“41a. (1) A payment under this Act to a State for the purposes of financial assistance is granted on the condition that the State will ensure that the benefits of, and the opportunities created by, the payment will, as far as practicable, be equally available to male students and female students.

“(2) Sub-section (1) does not apply in relation to payments in respect of student residences or affiliated colleges.

“(3) Sub-section (1) does not apply in relation to a payment made for the purpose of providing a course of instruction at a non-government business college all the students at which are of the same sex.

“(4) Where—

(a) the benefits of, or the opportunities created by, a particular project or program or particular expenditure would not, but for this sub-section, be equally available to male students and female students; and

(b) an object of the project, program or expenditure is to secure the adequate advancement of persons of one sex who require special assistance in order to ensure that persons of that sex have equal opportunities with persons of the other sex in connection with education or training,

the benefits of, or the opportunities created by, the project, program or expenditure shall not be taken, for the purposes of this Act, not to be equally available to male students and female students.”.

Payments may be made out of the Consolidated Revenue Fund or the Loan Fund

27. Section 46 of the Principal Act is amended by omitting from paragraph (a) “19, 21, 21a, 24, 25, 33, 34 or 34a” and substituting “13b, 19, 21, 21a, 21b, 24, 25, 33, 34, 34a or 34b”.

Authority to borrow

28. Section 47 of the Principal Act is amended by omitting “19, 21, 21a, 24, 25, 33, 34 and 34a” and substituting “13b, 19, 21, 21a, 21b, 24, 25, 33, 34, 34a and 34b”.

Application of moneys borrowed

29. Section 48 of the Principal Act is amended by omitting “19, 21, 21a, 24, 25, 33, 34 or 34a” and substituting “13b, 19, 21, 21a, 21b, 24, 25, 33, 34, 34a or 34b”.

Reimbursement of Consolidated Revenue Fund from Loan Fund

Consolidation of colleges of advanced education

31. Section 51 of the Principal Act is repealed.

Schedules

32. (1) Schedules 1 to 4 to the Principal Act are repealed and the Schedules set out in Schedule 1 to this Act are substituted.

(2) Schedule 6 to the Principal Act is repealed and the Schedule set out in Schedule 2 to this Act is substituted.

(3) Schedule 7a to the Principal Act is amended—

(a) by omitting Parts I and II and substituting the Parts set out in Schedule 3 to this Act; and

(b) by omitting Parts IV and V and substituting the Parts set out in Schedule 4 to this Act.

(4) Schedules 8, 9, 10 and 11 to the Principal Act are repealed and the Schedules set out in Schedule 5 to this Act are substituted.

(5) Schedule 12 to the Principal Act is amended—

(a) by omitting Part III and substituting the Parts set out in Schedule 6 to this Act; and

(b) by omitting Part V and substituting the Parts set out in Schedule 7 to this Act.

(6) Schedule 13 to the Principal Act is amended by omitting Parts III and IV and substituting the Parts set out in Schedule 8 to this Act.

(7) Schedules 14, 15 and 16 to the Principal Act are repealed and the Schedules set out in Schedule 9 to this Act are substituted.
