States Grants (Tertiary Education Assistance) Amendment Act 1981

An Act to amend the States Grants (Tertiary Education Assistance) Act 1978, and for related purposes

[Assented to 25 May 1981]

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:

Short title, &c.

1. (1) This Act may be cited as the States Grants (Tertiary Education Assistance) Amendment Act 1981.

(2) The States Grants (Tertiary Education Assistance) Act 19781 is in this Act referred to as the Principal Act.

Commencement

2. (1) Subject to this section, this Act shall come into operation on the day on which it receives the Royal Assent.

(2) Sub-section 6 (2) shall be deemed to have come into operation on 4 December 1978.

(3) Sub-section 6 (3) shall be deemed to have come into operation on 4 December 1979.

(4) Section 10 and sub-section 15 (2) shall be deemed to have come into operation on 6 June 1980.

Recurrent grants in respect of student residences and affiliated colleges

3. Section 9 of the Principal Act is amended—

(a) by omitting sub-sections (2a) and (2b) and substituting the following sub-sections:

“(2a) In relation to each student residence of a University, there is payable to the State in which the University is situated, in respect of the year 1980—

(a) an amount equal to the sum of $10,979 and the amount ascertained by multiplying $171.26 by the prescribed number of students for that year in relation to that student residence; or

(b) an amount ascertained by multiplying $387.92 by the prescribed number of students for that year in relation to that student residence,

whichever is the lesser amount.

“(2b) In relation to each student residence of a University, there is payable to the State in which the University is situated, in respect of the year 1981—

(a) an amount equal to the sum of $12,016 and the amount ascertained by multiplying $187.45 by the prescribed number of students for that year in relation to that student residence; or

(b) an amount ascertained by multiplying $424.58 by the prescribed number of students for that year in relation to that student residence,

whichever is the lesser amount.”; and

(b) by omitting sub-sections (4a) and (4b) and substituting the following sub-sections:

“(4a) For the purposes of sub-section (3), the basic grant in respect of an affiliated college for the year 1980 is—

(a) if the prescribed number of students for that year in relation to that college is less than 50—$387.92;

(b) if the prescribed number of students for that year in relation to that college is more than 49 but less than 75—$387.92 reduced by $2.93 for each student by which the prescribed number of students exceeds 50;

(c) if the prescribed number of students for that year in relation to that college is more than 74 but less than 100—$314.72 reduced by $1.46 for each student by which the prescribed number of students exceeds 75; or

(d) if the prescribed number of students for that year in relation to that college is more than 99—$278.15 reduced by $0.23 for each student by which the prescribed number of students exceeds 100.

“(4b) For the purposes of sub-section (3), the basic grant in respect of an affiliated college for the year 1981 is—

(a) if the prescribed number of students for that year in relation to that college is less than 50—$424.58;

(b) if the prescribed number of students for that year in relation to that college is more than 49 but less than 75—$424.58 reduced by $3.20 for each student by which the prescribed number of students exceeds 50;

(c) if the prescribed number of students for that year in relation to that college is more than 74 but less than 100—$344.77 reduced by $1.60 for each student by which the prescribed number of students exceeds 75; or

(d) if the prescribed number of students for that year in relation to that college is more than 99—$304.43 reduced by $0.25 for each student by which the prescribed number of students exceeds 100.”.

4. After section 11d of the Principal Act the following section is inserted in Part II:

Additional grants in respect of cost increases for major building projects of Universities for 1981

“11e. (1) Where, by reason of increases in the cost of an approved building project of a University, the expenditure on that project in respect of the year 1981 exceeds, or appears to the Minister likely to exceed, the amount of the approved expenditure on that project in respect of that year, there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to that project, in addition to the amount payable in respect of the project under section 11d, such amount as the Minister determines for the purposes of this section, not exceeding the amount of the excess or likely excess.

“(2) The total of the amounts payable to the States under sub-section (1) shall not exceed the amount specified in Part IX of Schedule 7b.

“(3) Sub-section 11d (9) applies to a grant of financial assistance under this section as if that grant were a grant of financial assistance under section 11d.

“(4) In this section—

(a) a reference to an approved building project of a University shall be read as a reference to—

(i) a building project specified in column 2 of Part I of Schedule 7b in relation to the University; or

(ii) a building project of the University approved by the Minister under paragraph 4 (1) (a) as an approved building project of the University in respect of the year 1981; and

(b) a reference to the amount of the approved expenditure on a project in respect of the year 1981 shall be read as a reference to—

(i) where the project is a building project specified in column 2 of Part I of Schedule 7b in relation to a University—the amount specified in column 4 of Part I of that Schedule in relation to that project; or

(ii) where the project is a building project of a University approved by the Minister under paragraph 4 (1) (a)—the amount of expenditure approved by the Minister under sub-section 4 (3) as the amount of the approved expenditure on the project in respect of the year 1981.”.

Interpretation

5. Section 12 of the Principal Act is amended by omitting from paragraph (c) of the definition of “college purposes” in sub-section (1) “of the amount specified in column 2 of Schedule 8” and substituting “of the amount specified in the column of Schedule 8 that relates to the year in which work on the project was commenced”.

Recurrent grants in respect of student residences and affiliated colleges

6. (1) Section 17 of the Principal Act is amended—

(a) by omitting sub-sections (2a) and (2b) and substituting the following sub-sections:

“(2a) In relation to each college of advanced education providing collegiate accommodation at a student residence or at student residences, there is payable to the State in which the college is situated, in respect of the year 1980—

(a) an amount equal to the sum of $10,979 and the amount ascertained by multiplying $171.26 by the number of resident full-time students at the student residence or at the student residences, as the case may be, in that year; or

(b) an amount ascertained by multiplying $387.92 by the number of resident full-time students at the student residence or at the student residences, as the case may be, in that year,

whichever is the lesser amount.

“(2b) In relation to each college of advanced education providing collegiate accommodation at a student residence or at student residences, there is payable to the State in which the college is situated, in respect of the year 1981—

(a) an amount equal to the sum of $12,016 and the amount ascertained by multiplying $187.45 by the number of resident full-time students at the student residence or at the student residences, as the case may be, in that year; or

(b) an amount ascertained by multiplying $424.58 by the number of resident full-time students at the student residence or at the student residences, as the case may be, in that year,

whichever is the lesser amount.”; and

(b) by omitting sub-sections (4a) and (4b) and substituting the following sub-sections:

“(4a) For the purposes of sub-section (3), the basic grant in respect of an affiliated college for the year 1980 is—

(a) if the number of resident full-time students at the college in that year is less than 50—$387.92;

(b) if the number of resident full-time students at the college in that year is more than 49 but less than 75—$387.92 reduced by $2.93 for each student by which that number of students exceeds 50;

(c) if the number of resident full-time students at the college in that year is more than 74 but less than 100—$314.72 reduced by $1.46 for each student by which that number of students exceeds 75; or

“(4b) For the purposes of sub-section (3), the basic grant in respect of an affiliated college for the year 1981 is—

(a) if the number of resident full-time students at the college in that year is less than 50—$424.58;

(b) if the number of resident full-time students at the college in that year is more than 49 but less than 75—$424.58 reduced by $3.20 for each student by which that number of students exceeds 50;

(c) if the number of resident full-time students at the college in that year is more than 74 but less than 100—$344.47 reduced by $1.60 for each student by which that number of students exceeds 75; or

(d) if the number of resident full-time students at the college in that year is more than 99—$304.43 reduced by $0.25 for each student by which that number of students exceeds 100.”.

(2) Section 17 of the Principal Act is amended by omitting from paragraph (b) of the definition “resident full-time student” in sub-section (9) “paragraph 13 (a)” and substituting “paragraph 13 (1) (a)”.

(3) Section 17 of the Principal Act is amended by omitting from sub-section (10) “paragraph 13 (a)” and substituting “paragraph 13 (1) (a)”.

Grants for courses of teacher education provided by non-government teachers colleges

7. Section 19 of the Principal Act is amended—

(a) by omitting from paragraph (2) (a) “$1,347,000” and substituting “$1,357,000”; and

(b) by omitting from paragraph (2) (b) “$1,455,000” and substituting “$1,569,000”.

Grants in respect of contributions to National Institute of Dramatic Art

8. Section 20 of the Principal Act is amended—

(a) by omitting from paragraph (1A) (b) “$554,000” and substituting “$565,500”; and

(b) by omitting from paragraph (1A) (c) “$571,000” and substituting “$621,500”.

Building projects in respect of the year 1980, &c.

9. (1) Section 21b of the Principal Act is amended by omitting sub-sections (5), (6), (7) and (8) and substituting the following sub-sections:

“(5) In relation to a design project specified in column 2 of Part V of Schedule 7a opposite to the name of a college of advanced education specified in column 1 of that Part, there is payable to the State in which that college is situated, in respect of the year 1980, for the purpose of financial assistance in relation to that design project, an amount equal to the amount specified in column 3 of that Part in respect of that project.

“(6) The Commission may revoke or vary an approval given under sub-section (2) and, if it varies the amount of the approved expenditure on a project in respect of the year 1980, then, for the purposes of this Act, the amount as so varied shall be deemed, as from the date on which the project was so approved, to have been the amount of the approved expenditure on the project in respect of the year 1980.”.

(2) Notwithstanding the amendments of the Principal Act made by sub-section (1), any variation of an approval given under sub-section 21b (2) of the Principal Act, being a variation that was made by the Commission under sub-section 21b (8) of that Act and was in force immediately before the date of commencement of this section, continues in force on and after that date as if it were a variation made under sub-section 21b (6) of the Principal Act as amended by this Act.

Additional grants in respect of cost increases for major building projects of colleges of advanced education for 1980

10. Section 21c of the Principal Act is amended—

(a) by omitting from sub-section (1) “sub-section 21b (3)” and substituting “sub-section 21b (1)”; and

(b) by omitting from sub-section (3) “sub-section 21b (3)” and substituting “sub-section 21b (1)”.

11. After section 21d of the Principal Act the following section is inserted:

Additional grants in respect of cost increases for major building projects of colleges of advanced education for 1981

“21e. (1) Where, by reason of increases in the cost of an approved building project of a college of advanced education, the expenditure on that project in respect of the year 1981 exceeds, or appears to the Minister likely to exceed, the amount of the approved expenditure on that project in respect of that year, there is payable to the State in which the college is situated, for the purpose of financial assistance in relation to the project, in addition to the amount payable in respect of the project under sub-section 21d (1), such amount as the Minister determines for the purposes of this section, not exceeding the amount of the excess or likely excess.

“(2) The total of the amounts payable to a State under sub-section (1) shall not exceed the amount specified in column 2 of Part X of Schedule 7b opposite to the name of the State in column 1 of that Part.

“(3) Sub-section 21d (9) applies to a grant of financial assistance under this section as if that grant were a grant of financial assistance under sub-section 21d (1).

“(4) In this section—

(a) a reference to an approved building project of a college of advanced education shall be read as a reference to—

(i) a building project specified in column 2 of Part IV of Schedule 7b in relation to the college; or

(ii) a building project of the college approved by the Minister under paragraph 4 (1) (b) as an approved building project of the college in respect of the year 1981; and

(b) a reference to the amount of the approved expenditure on a project in respect of the year 1981 shall be read as a reference to—

(i) where the project is a building project specified in column 2 of Part IV of Schedule 7b in relation to a college of advanced education—the amount specified in column 4 of Part IV of that Schedule in relation to that project; or

(ii) where the project is a building project of a college of advanced education approved by the Minister under paragraph 4 (1) (b)—the amount of expenditure approved by the

Minister under sub-section 4 (3) as the amount of the approved expenditure on the project in respect of the year 1981.”.

12. After section 29d of the Principal Act the following section is inserted:

Additional grants in respect of cost increases for major building projects of technical and further education institutions for 1981

“29e. (1) Where, by reason of increases in the cost of an approved building project of a technical and further education institution, the expenditure on the project in respect of the year 1981 exceeds, or appears to the Minister likely to exceed, the amount of the approved expenditure on that project in respect of that year, there is payable to the State in which the institution is situated, for the purpose of financial assistance in relation to the project, in addition to the amount payable in respect of the project under section 29d, such amount as the Minister determines for the purposes of this section, not exceeding the amount of the excess or likely excess.

“(2) The total of the amounts payable to a State under sub-section (1) shall not exceed the amount specified in column 3 of Part X of Schedule 7b opposite to the name of the State in column 1 of that Part.

“(3) Sub-section 29d (2) applies to a grant of financial assistance under this section as if that grant were a grant of financial assistance under section 29d.

“(4) In this section—

(a) a reference to an approved building project of a technical and further education institution shall be read as a reference to—

(i) a building project specified in column 2 of Part VII of Schedule 7b in relation to the institution; or

(ii) a building project of the institution approved by the Minister under paragraph 4 (1) (c) as an approved building project of the institution in respect of the year 1981; and

(b) a reference to the amount of the approved expenditure on a project in respect of the year 1981 shall be read as a reference to—

(i) where the project is a building project specified in column 2 of Part VII of Schedule 7b in relation to a technical and further education institution—the amount specified in column 4 of Part VII of that Schedule in relation to that project; or

(ii) where the project is a building project of a technical and further education institution approved by the Minister under paragraph 4 (1) (c)—the amount of expenditure approved by the Minister under sub-section 4 (3) as the amount of the approved expenditure on the project in respect of the year 1981.”.

Grants for approved courses provided by non-government business colleges

13. (1) Section 30d of the Principal Act is amended by omitting sub-sections (1) and (2) and substituting the following sub-sections:

“(1) The Minister shall, after 31 December in each year to which this Act applies, authorize the payment to a State under this section, by way of financial assistance to the State in respect of recurrent expenditure of a non-government business college in providing in that State, in that year, a course that is an approved course of that college in respect of that year, of such an amount as the Minister determines.

“(2) The Minister shall not authorize the payment to a State under sub-section (1), in relation to the provision in that State by a nongovernment business college, in a year to which this Act applies, of an approved course of that college in respect of that year, of an amount that exceeds the sum of the amounts (if any) respectively ascertained in respect of each of the months of that year by multiplying the amount specified in column 2, 3 or 4 (whichever is appropriate) of Schedule 15 as the maximum capitation amount in respect of that month of that year by the total number of students receiving instruction in that course in that State on the business college census date for that month.”.

(2) Payments by way of financial assistance made before the commencement of this section to a State by the Minister under section 30d of the States Grants (Tertiary Education Assistance) Act 1978 as amended and in force on or at any time after 11 June 1979 in relation to the provision in that State by a non-government business college, in a year to which this Act applies, of an approved course of that college in respect of that year, shall be deemed to have been made, by way of financial assistance to the State, by the Minister for Finance, in accordance with section 35, as advances on account of an amount that is expected to become payable under section 30d of the Principal Act as amended by this Act in relation to the provision in that State by that college of that course in that year.

Grants for special teacher training initiatives

14. Section 30e of the Principal Act is amended—

(a) by omitting from sub-section (8) “$889,000” and substituting “$882,000”; and

(b) by omitting from sub-section (8a) “$1,668,000” and substituting “$1,661,000”.

Variation of building grants

15. (1) Section 31 of the Principal Act is amended—

(a) by omitting from paragraph (4) (c) “and 29d,” and substituting “, 21e, 29d and 29e.”;

(b) by omitting paragraph (5) (e) and substituting the following paragraph:

“(e) that will have the effect of increasing or decreasing the aggregate of the amounts that may be paid to a State in respect of the year 1981 under—

(i) section 11d;

(ii) sections 21d and 21e; or

(iii) sections 29d and 29e.”;

(d) by omitting paragraph (6) (ba) and substituting the following paragraph:

“(ba) that could result in the aggregate of the amounts payable to the States under sections 11d, 11e, 21d, 21e, 29d and 29e being greater or less than $133,643,805; or”.

(2) Section 31 of the Principal Act is amended—

(a) by omitting from paragraph (4) (b) “11c,”; and

(b) by omitting sub-paragraph (5) (d) (i) and substituting the following sub-paragraph:

“(i) section 11b;”.

Payments to be made out of Consolidated Revenue Fund or Loan Fund

16. Section 36 of the Principal Act is amended by omitting “16, 21, 21a, 21b, 21c, 21d, 29, 29a, 29b, 29c, 29d” and substituting “11e, 16, 21, 21a, 21b, 21c, 21d, 21e, 29, 29a, 29b, 29c, 29d, 29e”.

Authority to borrow

17. Section 37 of the Principal Act is amended by omitting “16, 21, 21a, 21b, 21c, 21d, 29, 29a, 29b, 29c, 29d” and substituting “11e, 16, 21, 21a, 21b, 21c, 21d, 21e, 29, 29a, 29b, 29c, 29d, 29e”.

Application of moneys borrowed

18. Section 38 of the Principal Act is amended by omitting “16, 21, 21a, 21b, 21c, 21d, 29, 29a, 29b, 29c, 29d” and substituting “11e, 16, 21, 21a, 21b, 21c, 21d, 21e, 29, 29a, 29b, 29c, 29d, 29e”.

Reimbursement of Consolidated Revenue Fund from Loan Fund

19. Section 39 of the Principal Act is amended by omitting from subsection (1) “16, 21, 21a, 21b, 21c, 21d, 29, 29a, 29b, 29c, 29d” and substituting “11e, 16, 21, 21 A, 21b, 21c, 21d, 21e, 29, 29a, 29b, 29c, 29d, 29e”.

Substitution of Schedules

20. (1) Schedules 1, 2, 3, 4, 5 and 6 to the Principal Act are repealed and the Schedules set out in Schedule 1 to this Act are substituted.

(2) Schedules 7a, 7b, 8, 8a, 9, 10, 11, 12 and 13 to the Principal Act are repealed and the Schedules set out in Schedule 2 to this Act are substituted.

(3) The Principal Act is amended by adding at the end thereof the Schedule set out in Schedule 3 to this Act.

Certain directions to cease to have effect

21. A direction given by the Minister under sub-section 6 (5), 15 (3), (4), (5), (6) or (7), 15a (1), 26 (1) or 31 (1) or (3) of the Principal Act or by the Tertiary Education Commission under sub-section 6 (4), 15 (1) or (2), 15a (2), 26 (2) or 31 (2) of that Act shall, by force of this section, cease to have effect upon the commencement of this Act, but this section shall not be taken to affect the previous operation of the direction.

Payments made before Royal Assent

22. Payments (including advances) by way of financial assistance made to a State under the Principal Act shall be deemed to have been made for the purposes of the Principal Act as amended by this Act.

Transitional

23. For all purposes of the States Grants (Tertiary Education Assistance) Act 1978, as in force either before or after the commencement of this Act—

(a) a reference to the State Colleges of Victoria System shall be read as a reference to the system of colleges that, immediately before the repeal of section 3 of the State College of Victoria Act 1972 of Victoria, comprised the constituent colleges of the State College of Victoria; and

(b) a reference to the Victoria Institute of Colleges System shall be read as a reference to the system of colleges that, immediately before the repeal of section 3 of the Victoria Institute of Colleges Act 1965 of Victoria, comprised the affiliated colleges of the Victoria Institute of Colleges.
