Overview

The States Grants (Technical and Further Education) Amendment Act (No. 2) 1976 was enacted by the Queen, and the Senate and House of Representatives of the Commonwealth of Australia. This Act aimed to amend the States Grants (Technical and Further Education) Act 1974, addressing issues related to funding allocations for technical and further education in the states. It focused on adjusting grant amounts and updating certain provisions to align with the evolving needs of the education sector. The policy objective of this amendment was to ensure adequate and equitable funding to support the expansion and improvement of technical and further education infrastructure and programs across the states. The Act came into operation on the day it received Royal Assent, ensuring that the adjustments to grants and provisions were implemented without delay.

Scope and Application

The States Grants (Technical and Further Education) Amendment Act (No. 2) 1976 amends the States Grants (Technical and Further Education) Act 1974, which pertains to the allocation and management of Commonwealth grants to Australian states for technical and further education. The amendment applies to the states and territories of Australia, directly affecting their education sectors. It specifically alters provisions concerning grants for student residence building projects, recurrent expenditure, and in-service teacher training programs by adjusting figures and clarifying the scope of the grants. The Act's amendments are effective from the date it receives Royal Assent, ensuring that any financial assistance provided prior to this date is still recognised under the amended Act. The amendment also introduces new schedules detailing the maximum grants for major and minor building projects, as well as recurrent and particular purpose grants, tailored to each state's needs. This Act extends the application of the original legislation through its formal amendments and updated schedules, without explicitly stating exclusions or exemptions, thus maintaining the broad applicability intended by the original Act.

Key Provisions

The main provisions of the States Grants (Technical and Further Education) Amendment Act (No. 2) 1976 (Act) are contained in Sections 3 to 8 and involve amendments to the States Grants (Technical and Further Education) Act 1974 (Principal Act). Section 3 increases the maximum grant for student residence building projects from $4,000,000 to $4,360,000. Section 4 modifies the reference to the year in Sections 10, 12, and 18 of the Principal Act, replacing "in a year" with "in respect of a year" to clarify the scope of the grant years. Similarly, Section 5 and Section 6 make the same adjustments to Sections 15 and 18, respectively. These changes ensure that the grants are tied to specific years covered by the Act. Schedules 1 to 5 replace the existing schedules in the Principal Act with new ones detailing the maximum grants for major and minor building projects, general purpose recurrent grants, particular purpose recurrent grants, and grants for in-service teacher training programs. The Act imposes specific obligations on the parties it governs, primarily the Commonwealth of Australia and the participating states. The Commonwealth is responsible for the disbursement of grants as amended by the Act. The participating states must comply with the conditions and limits set out in the schedules, ensuring that the funds are used for the specified purposes of technical and further education. The states must also adhere to the new temporal references introduced by Sections 4 to 6, which align the grant years with the Act's provisions. The Act does not explicitly outline specific offences, penalties, or civil/criminal consequences for breaches of its provisions. However, non-compliance with the terms of the grants could potentially lead to the withholding of future funding or legal action to recover improperly used funds. The penalties and consequences for such breaches would likely be determined in accordance with the general legal framework governing public funds and grants in Australia, which could include administrative, civil, or criminal penalties depending on the severity and intent of the breach.
