Overview

The States Grants (Schools) (Boards for Catholic Systemic Schools) Regulations 1974 were enacted under the States Grants (Schools) Act 1973. This legislative instrument was introduced to address the need for establishing and regulating the operations of Boards for Catholic Systemic Schools in Australia. The Regulations were made by the Governor-General, acting on the advice of the Executive Council, and came into effect on 24 January 1974. The objective of these Regulations was to ensure that there were governing bodies for Catholic systemic schools, composed of members appointed by both the Minister and the Roman Catholic Education Authorities, thereby providing a structured framework for the administration of these schools and ensuring representation from both secular and religious authorities.

Scope and Application

The States Grants (Schools) (Boards for Catholic Systemic Schools) Regulations 1974, made under the States Grants (Schools) Act 1973, establish the framework for the establishment and operation of Boards for Catholic Systemic Schools in each state. These Regulations apply to the establishment of Boards for Catholic Systemic Schools for each state, their constitution, and the appointment and operation of their members, including the Chairman. The Boards consist of five members, two appointed by the Minister and three appointed by the Roman Catholic Education Authorities in each state. The Regulations also outline the procedures for resignations, vacancies, and the election of the Chairman, as well as the requirements for meetings, quorum, and the tenure of office, which ends on 31 December 1975. These Regulations extend the application of the Act by providing detailed provisions for the establishment and operation of the Boards, ensuring that the objectives of the Act are effectively implemented at the state level.

Key Provisions

These Regulations establish the framework for Boards for Catholic Systemic Schools under the States Grants (Schools) Act 1973, specifically focusing on their establishment, constitution, and operations (regs 3–8). Each state in Australia is required to have a Board for Catholic Systemic Schools, composed of five members, two appointed by the Minister and three by the Roman Catholic Education Authorities in that state (reg 4(1)). The members can resign by submitting a written notice to the appropriate appointing authority, and vacancies must be filled by the same appointing authority (regs 4(2)–(4)). The Board members elect a Chairman from among themselves, who may also resign by written notice to the other Board members (regs 5(1) and (2)). The Regulations mandate that the Board must hold meetings as determined by the Chairman or as fixed by a Board resolution, with the Chairman presiding unless absent, in which case a new Chairman is elected for that meeting (reg 6). A quorum for any Board meeting requires at least three members, including one Minister-appointed member and two members appointed by the Roman Catholic Education Authorities (reg 7). Board members serve until 31 December 1975, unless their tenure ends earlier due to death, resignation, or another vacancy (reg 8). Failure to comply with the provisions of these Regulations may not explicitly state penalties but would likely fall under the general legal consequences for non-compliance with statutory provisions under the States Grants (Schools) Act 1973. Such consequences may include legal actions for enforcement, administrative sanctions, or other measures deemed necessary by the relevant authorities to ensure adherence to the legislative framework.
