NOTE

1. No. 135, 1980, as amended. For previous amendments, see Nos. 52, 61 and 162, 1981.

Overview

The States Grants (Schools Assistance) Amendment Act 1982, enacted by the Queen, the Senate, and the House of Representatives of the Commonwealth of Australia, serves to amend the States Grants (Schools Assistance) Act 1980. This amendment aims to update certain financial provisions and grant allocations in response to the changing needs of state and territory education systems. By modifying the specific monetary limits and substituting updated schedules for grant distributions, this legislation ensures that the financial assistance provided under the principal act is reflective of the current requirements and commitments. This act provides a mechanism for the Commonwealth to adjust its support to state and territory governments in the provision of school education, addressing the identified gaps in funding allocations. The policy objective of the Act is to provide a more accurate and responsive financial framework for supporting educational infrastructure, recurrent expenditure, and special needs within schools across Australia. By adjusting the grant limits and updating the schedules for various types of educational assistance, the Act aims to ensure that the necessary funds are allocated effectively to meet the evolving demands of the education sector.

Scope and Application

The States Grants (Schools Assistance) Amendment Act 1982 applies to the Commonwealth of Australia and amends the States Grants (Schools Assistance) Act 1980 by making adjustments to the financial assistance provided to the various states and territories for educational purposes. The Act specifically targets the allocation of funds for building and equipment projects, recurrent expenditure in government and non-government schools, support for disadvantaged schools and regions, special schools, and various other educational grants. The amendments include new financial limits and revised allocations detailed in the substituted schedules. Notably, the Act ensures that payments made under the original Act prior to its amendment are still considered valid under the amended Act. This legislative amendment affects the financial relationship between the Commonwealth and the states and territories, ensuring that the distribution of funds for educational infrastructure and support continues to meet the needs of the respective regions.

Key Provisions

The States Grants (Schools Assistance) Amendment Act 1982 makes specific amendments to the States Grants (Schools Assistance) Act 1980. The Act modifies the limits on grants under sections 40 and 41c of the Principal Act, effectively increasing the cap on grants from $1,123,000 to $1,134,500 under section 41 and from $2,246,000 to $2,269,000 under section 41c. Additionally, the Act repeals and replaces Schedules 1 to 4 and Schedules 7 to 10 of the Principal Act with new schedules detailing allocations for various categories such as building and equipment projects, recurrent expenditure, migrant education, and special schools, among others. Payments made before the Royal Assent are deemed to have been made for the purposes of the amended Principal Act. The obligations imposed by the Act primarily concern the recalibration of financial commitments and redistribution of funds as per the newly established limits and schedules. The Act mandates that payments made under the Principal Act, even those made before the Act's assent, are to be considered as payments under the amended Act. This ensures continuity and legal validity of the financial assistance provided to the states and the Northern Territory. The new schedules detail specific allocations for different educational categories and states, which the relevant authorities must adhere to in disbursing funds. Breaches of the provisions set out in the Act could lead to various legal consequences, although the Act itself does not explicitly state penalties for non-compliance. Generally, failure to adhere to the prescribed limits and schedules could result in financial discrepancies and potential legal challenges. However, the specific consequences, including any fines or other penalties, would depend on broader legal frameworks and administrative regulations governing the implementation of the Act. The maximum penalties would likely be dictated by other relevant statutes or administrative guidelines rather than the Act itself.
