Overview

The States Grants (Roads) Amendment Act 1979 (Cth) was enacted by the Commonwealth Parliament to amend the States Grants (Roads) Act 1977. The 1979 Act addresses the need for updating the financial assistance distribution for road projects among the states. It ensures that the allocation of funds remains equitable and reflective of the current needs and developments in road infrastructure across Australia. The purpose of this amendment is to adjust the schedules that detail the division and amounts of grants for various categories of roads, including national roads, national highways, and roads other than national roads, to better align with the fiscal year beginning on 1 July 1979. This legislative change does not affect the entitlements of states to financial assistance for years prior to 1 July 1979, maintaining continuity in funding commitments while updating the framework for future allocations. The Act was passed to ensure that the financial support provided under the Principal Act is effectively and efficiently distributed among the states, promoting the development and maintenance of a robust and reliable road network. By updating the schedules to reflect the new financial year, the 1979 Amendment Act aims to support ongoing and future infrastructure projects that are crucial for economic growth and connectivity across Australia.

Scope and Application

The States Grants (Roads) Amendment Act 1979 applies to the financial assistance provided by the Commonwealth to the states under the States Grants (Roads) Act 1977 for road-related projects. It amends the schedules of the Principal Act, which set out the division of grants among the states for the financial year commencing 1 July 1979 and subsequent years. The amendment affects the financial assistance entitlement for each state in respect of national roads, national highways, national commerce roads, and other roads. However, it does not affect the entitlement of a state to financial assistance in respect of any year before the year that commenced on 1 July 1979. The Act applies to the six Australian states: New South Wales, Victoria, Queensland, South Australia, Western Australia, and Tasmania. The amendment comes into operation on the day it receives the Royal Assent. The Act does not provide for any exclusions, exemptions, or thresholds, and it does not extend or restrict its application through subordinate instruments.

Key Provisions

The main operative sections of the States Grants (Roads) Amendment Act 1979 (Act) include the repeal of the Schedules to the Principal Act and the substitution of new Schedules (Section 3). These Schedules detail the division of total grants among states for different types of roads and highway projects for the years commencing 1 July 1977, 1 July 1978, and 1 July 1979. Specifically, the new Schedules provide the amounts of grants for the construction and maintenance of national highways, national commerce roads, and other roads, such as rural arterial roads, rural local roads, and urban roads, along with minor traffic engineering and road safety improvements. The Act also ensures that the amendment does not affect the entitlement of a state to financial assistance for any year before 1 July 1979, and it applies reductions or increases to quotas in accordance with the new Schedules (Section 4). The Act imposes obligations and requirements on the Commonwealth to provide financial assistance to the states in the form of grants for road projects. These grants are distributed based on the criteria and amounts specified in the new Schedules. The states, in turn, are required to use these grants for the specific purposes outlined in the Act, such as the construction and maintenance of national highways, national commerce roads, and other roads, as well as for minor traffic engineering and road safety improvements. Additionally, the Act mandates that the distribution of grants is to be based on the quotas specified in the new Schedules. Breach of the provisions of the Act does not explicitly outline specific offences, penalties, or civil/criminal consequences within the text provided. However, it is reasonable to infer that failure to comply with the requirements for the use of grants or misuse of funds could potentially lead to legal consequences. Such consequences could include financial penalties, recovery of misused funds, or other administrative actions as deemed necessary by the relevant authorities. Given that the Act is concerned with financial grants and allocations, breaches could also potentially involve financial audits and investigations to ensure compliance with the intended use of funds.
