Overview

The States Grants (Primary and Secondary Education Assistance) Amendment Act (No. 2) 2002 was enacted to amend the States Grants (Primary and Secondary Education Assistance) Act 2000. This amendment was introduced to adjust the funding allocations for primary and secondary education assistance for the years 2005, 2006, and 2007. The Act was passed by the Parliament of Australia and received Royal Assent on 31 October 2002. The primary objective of this legislation is to ensure that the funding provisions are updated to reflect the changing needs and circumstances of primary and secondary education in Australia, thereby supporting the ongoing provision of quality education across the states and territories. The Act makes specific changes to the schedules of the 2000 Act, notably adjusting the financial figures and notes related to the grant allocations for the specified years.

Scope and Application

The States Grants (Primary and Secondary Education Assistance) Amendment Act (No. 2) 2002 amends the States Grants (Primary and Secondary Education Assistance) Act 2000, enhancing the framework for financial assistance provided by the Commonwealth to states for primary and secondary education. This Act applies to the states of Australia, including the Australian Capital Territory and the Northern Territory, as these entities are the recipients of the financial grants outlined in the legislation. The amendments focus on modifying the funding allocations for the years 2005, 2006, and 2007, ensuring that the financial support remains aligned with the evolving needs of the education sector. The Act's jurisdictional reach is national, with the Commonwealth directly influencing educational funding across all states and territories. The Act does not specify exclusions, exemptions, or thresholds but provides the basis for further regulations and operational details to be defined through subordinate instruments.

Key Provisions

The States Grants (Primary and Secondary Education Assistance) Amendment Act (No. 2) 2002 amends the States Grants (Primary and Secondary Education Assistance) Act 2000. The key amendments are found in Schedule 1, where certain rows and notes in Schedules 3 and 5 are repealed and substituted. Specifically, the table rows relating to the years 2005, 2006, and 2007 in Schedule 3 are repealed and replaced with new figures, as are the corresponding rows in Schedule 5. Additionally, notes 1 and 2 in Schedule 3, and notes 1 and 2 in Schedule 5 are repealed and replaced with a single note. This Act imposes specific obligations on the government to ensure that the financial assistance provided to states for primary and secondary education is accurately calculated and appropriately distributed. The amendments in Schedule 1 are intended to update the figures used in the calculations for the financial years 2005, 2006, and 2007, ensuring that the assistance provided aligns with the most current economic and educational data. By repealing and substituting the relevant rows and notes, the Act aims to maintain the integrity and effectiveness of the financial assistance program. Failure to comply with the provisions of this Act could result in incorrect financial assistance being provided to the states, potentially leading to significant budgetary and educational implications. Although the Act itself does not specify particular offences or penalties for non-compliance, breaches of the amended provisions could lead to investigations by the relevant authorities and may result in corrective actions to rectify any misallocation of funds. The consequences for entities that do not adhere to the updated figures and notes could include financial penalties or other administrative actions to ensure compliance with the legislative requirements.
