Overview
The States Grants (Education Assistance—Participation and Equity) Amendment Act 1987 was enacted by the Parliament of Australia to amend the States Grants (Education Assistance—Participation and Equity) Act 1983. The primary purpose of this amendment was to address issues of equity and participation in education funding across different states and territories by adjusting the allocation of funds for various educational projects and programs. The Act provides for specific increases in the limits on grants for government, non-government, and technical and further education projects and programs for the years 1984 to 1987. Additionally, it replaces the schedules of the Principal Act with new schedules detailing the amounts allocated to each state and territory for the year 1987. The Act was assented to on 5 June 1987, ensuring that payments made prior to this date would be considered valid under the amended Act.
Scope and Application
The States Grants (Education Assistance—Participation and Equity) Amendment Act 1987 amends the States Grants (Education Assistance—Participation and Equity) Act 1983. The Act applies to the Commonwealth of Australia and is concerned with the allocation of grants to the states and territories for educational assistance, particularly focusing on participation and equity within the education sector. The Act modifies the financial allocations for educational grants under the Principal Act for the years 1984 to 1987 by increasing the funding limits for government schools, non-government schools, and technical and further education programs in each state and the Northern Territory. These revised amounts are detailed in the new schedules substituted for the repealed schedules 10, 11, and 12 of the Principal Act. The Act's application is limited to the specific financial years mentioned and the particular educational sectors outlined, without specifying exclusions or exemptions beyond the scope of its stated purpose. The Act’s operation is immediate upon receiving Royal Assent and also retrospectively validates payments made before this date.
Key Provisions
The main operative sections of the States Grants (Education Assistance—Participation and Equity) Amendment Act 1987 (C2004A03447) are found in sections 3, 4, 5 and 6. Section 3 amends the Principal Act by increasing the limit on grants in respect of the years 1984, 1985, 1986, and 1987, from $41,243,000 to $42,241,000. Section 4 modifies the Principal Act by raising the limit on grants under section 20 for the same years, from $345,000 to $353,000. Section 5 adjusts the Principal Act by changing the limit on grants under section 22a for the years 1985, 1986, and 1987, from $612,000 to $649,000. Finally, Section 6 repeals Schedules 10, 11, and 12 of the Principal Act and substitutes new schedules detailing government, non-government, and technical and further education projects and programs for 1987.
The Act imposes specific obligations and requirements on the Commonwealth and the States in terms of financial assistance for educational projects and programs. The Commonwealth is required to provide financial assistance to the States and the Northern Territory for government, non-government, and technical and further education projects and programs, as outlined in the new schedules. The States, in turn, must ensure that the funds provided are used in accordance with the terms and conditions set out in the Principal Act and this amending Act. The Act also requires that payments made under the Principal Act before the Royal Assent of this amending Act be deemed to have been made for the purposes of the Principal Act as amended by this Act.
There are no specific offences, penalties, or civil or criminal consequences mentioned in the Act for breaches of its provisions. However, any breach of the terms and conditions of the financial assistance provided under the Principal Act, as amended by this Act, may result in the Commonwealth withholding further payments or taking other appropriate action to ensure compliance with the Act. The Act relies on the general legal framework and the enforcement mechanisms available under Australian law to address non-compliance and ensure adherence to its provisions.
