Overview

The States Grants (Education Assistance—Participation and Equity) Amendment Act 1986 was enacted by the Parliament of Australia to amend the States Grants (Education Assistance—Participation and Equity) Act 1983. The principal purpose of this amendment was to address the need for updated financial allocations and grant limits to ensure the equitable distribution of education assistance funds to the states and territories for the years 1984, 1985, and 1986. The Act introduced new funding limits and revised the distribution schedules for government, non-government, and technical and further education projects and programs. The policy objective was to provide adequate funding to support participation and equity in education across the nation.

Scope and Application

The States Grants (Education Assistance—Participation and Equity) Amendment Act 1986 amends the States Grants (Education Assistance—Participation and Equity) Act 1983, which provides financial assistance to the states and territories of Australia for education purposes. The amendment act applies to the Commonwealth of Australia, including its states and territories, and is concerned specifically with the financial assistance provided under the Principal Act. It adjusts the limits on grants for certain years and substitutes new schedules detailing the allocation of funds for government, non-government, and technical and further education projects and programs across the various states and the Northern Territory. The Act comes into operation on the day it receives the Royal Assent, and it ensures that payments made prior to this are deemed to have been made under the amended Act. The amendment act does not introduce any exclusions or exemptions, but it does specify the new financial parameters and allocations for educational assistance grants.

Key Provisions

The States Grants (Education Assistance—Participation and Equity) Amendment Act 1986 (section 3) adjusts the financial limits for grants under the Principal Act for the years 1984, 1985, and 1986. Specifically, it increases the maximum amount for education assistance grants from $39,144,000 to $39,879,000, the cap for grants under section 20 from $327,000 to $335,000, and the limit for grants under section 22a from $576,000 to $592,000. Furthermore, the Act sets a new limit for grants under the Act for 1987 at $43,246,000 (section 6). In addition to financial amendments, the Act also repeals and replaces Schedules 7, 8, and 9 of the Principal Act with new schedules detailing the distribution of funds to various education projects and programs across different states and territories for 1986 (section 7). The Act imposes obligations on the Commonwealth to allocate the specified amounts to the respective states and territories for the outlined education projects and programs. The amendments to the Principal Act necessitate that these funds be directed towards enhancing educational participation and equity. The states and territories, in turn, are expected to utilise these grants for the purposes designated in the new schedules, ensuring that the allocated funds contribute effectively to improving educational outcomes and equity within their jurisdictions. The Act does not explicitly outline specific offences or penalties for non-compliance with its provisions. However, failure to adhere to the stipulated financial limits and obligations could potentially result in legal challenges or disputes regarding the allocation and use of the funds. The implications of non-compliance could include the need for judicial interpretation or the requirement to return misallocated funds, thereby ensuring that the intent of the Act to support equitable education assistance is upheld. The maximum penalties, if any, would be determined in the context of such legal proceedings.
