Overview

The States Grants (Advanced Education) Act (No. 2) 1973 was enacted to amend the States Grants (Advanced Education) Act 1969-1972, aiming to address funding gaps in advanced education infrastructure across various educational institutions in Australia. The Act was passed by the Queen, the Senate, and the House of Representatives of Australia, signifying its importance and wide-ranging impact on educational funding. The policy objective behind this amendment was to ensure that specific institutions received adequate financial support for their development and expansion, thereby enhancing the quality and accessibility of advanced education. This legislative action underscores a commitment to providing necessary resources to educational entities, facilitating their growth and improvement in alignment with national educational priorities.

Scope and Application

The States Grants (Advanced Education) Act (No. 2) 1973 applies to the allocation and distribution of financial grants for advanced education purposes in Australia. It amends the States Grants (Advanced Education) Act 1969-1972, which primarily involves the Commonwealth Government providing financial assistance to state governments for advanced education initiatives. This Act affects state governments, educational institutions, and relevant educational boards by adjusting specific financial allocations for various educational projects, as outlined in the Second Schedule. The geographic reach of this legislation is national, as it involves the Commonwealth Government and state governments across Australia. The Act does not explicitly state any exclusions, exemptions, or thresholds, but the adjustments to funding figures suggest that it may target specific educational projects or institutions. This Act can be further extended or restricted through subordinate instruments, such as regulations or guidelines, which may provide additional details on the implementation and application of the amended grants.

Key Provisions

The States Grants (Advanced Education) Act (No. 2) 1973 amends the existing States Grants (Advanced Education) Act 1969-1972, referred to in the Act as the Principal Act. Upon enactment, the Principal Act, as amended, may be cited as the States Grants (Advanced Education) Act 1969-1973. This Act modifies the allocation of grants for various educational institutions across different states, specifically detailing funding for projects such as the purchase of land for a future college in Campbelltown by the New South Wales Advanced Education Board, and adjustments in funding for several other institutions including the National Art School, the New South Wales Institute of Technology, Prahran College of Technology, and The Emily McPherson College. Entities governed by this Act are required to adhere to the updated financial allocations set out in the amended Second Schedule. These institutions must ensure that their projects align with the specified funding amounts, which now reflect adjustments in costs for construction and land acquisition. For example, the New South Wales Advanced Education Board must now allocate $55,118 for the purchase of land for a future college at Campbelltown, a change from previous allocations. Similarly, the New South Wales Institute of Technology has its funding adjusted for the erection of a science building on the North Sydney site, now totalling $73,772. Prahran College of Technology must adjust its budget for the purchase of land to $117,375 and for alterations and additions to existing buildings to $224,250. The Emily McPherson College's funding for planning has been reduced to $19,000, while funding for alterations to existing buildings has increased to $106,000. Failure to comply with the financial stipulations as outlined in the Act may lead to discrepancies in the funding of the educational projects, potentially resulting in legal repercussions for the institutions involved. While the Act does not explicitly state penalties for non-compliance, breaches of such financial agreements could be subject to civil or administrative consequences as per other governing legislation. Institutions must ensure accurate and timely reporting of their financial activities to avoid any legal complications.
