States Grants (Advanced Education)

An Act to amend the States Grants (Advanced Education) Act 1969, and to provide for Payments to certain States in relation to certain Places of Education.

[Assented to 11 November 1970]

BE it enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows:—

Short title and citation.

1.—(1.) This Act may be cited as the States Grants (Advanced Education) Act 1970.

(2.) The States Grants (Advanced Education) Act 1969 is in this Act referred to as the Principal Act.

(3.) The Principal Act, as amended by this Act, may be cited as the States Grants (Advanced Education) Act 1969–1970.

Commencement.

2. This Act shall come into operation on the day on which it receives the Royal Assent.

First Schedule.

3. The First Schedule to the Principal Act is repealed and the Schedule set out in the First Schedule to this Act inserted in its stead.

Second Schedule.

4. The Second Schedule to the Principal Act is amended—

(a) by omitting from the second and third columns opposite to the words “South Australian Institute of Technology” in the first column the words and figures—

“Erection of applied science buildings.....................

1,397,500”

and inserting in their stead the words and figures—

“Erection of applied science buildings.....................	1,335,000
Completion of metallurgy building......................	62,500”;

and

(b) by omitting from the second and third columns opposite to the words “Western Australian Institute of Technology” in the first column the words and figures—

“Erection of administration and general purposes building on the Muresk site

150,000”

and inserting in their stead the words and figures—

“Erection of administration and general purposes building on the Muresk site	110,000
Erection of Watson lecture theatre.......................	40,000”.

Additional payments to certain States in relation to triennium 1967-1969.

5.—(1.) There is payable to a State specified in column two of the table, in relation to a college of advanced education referred to in column three of the table opposite to the State, for the purpose of financial assistance, an amount equal to the amount by which the specified amount in relation to that college in respect of a year specified in column one of the table opposite to that college exceeds the amount paid under the Act to the State in relation to that college in respect of that year.

(2.) The financial assistance to a State under this section in relation to a college of advanced education is granted on the condition that the State has applied in expenditure, other than capital expenditure, for the college purposes of the college in respect of the year concerned an amount not less than the amount of the financial assistance.

(3.) For the purposes of this section, the places of education that are referred to in column three of the table opposite to the State of New South Wales shall be deemed to be one college of advanced education.

(4.) For the purposes of this section—

“capital expenditure” and “college purposes” have the same respective meanings as they have in the Act;

“specified amount”, in relation to a college of advanced education referred to in column three of the table in respect of a year specified in column one of the table opposite to that college, is the amount that would have been payable, under the Act, to a State, in relation to that college, in respect of that year, if the amounts

specified in column four and column five of the table opposite to that college and to that year had been substituted for the amounts specified opposite to that college in the second column and the third column, respectively, of that Part of the First Schedule to the Act that relates to that year;

“the Act” means the States Grants (Advanced Education) Act 1967-1969;

“the table” means the table set out in the Second Schedule to this Act.

Grant in respect of Agricola College in respect of the years 1971 and 1972.

6.—(1.) There is payable to the State of Western Australia, in respect of a year to which this section applies, for the purpose of financial assistance in relation to Agricola College at Kalgoorlie—

(a) an amount of Five thousand dollars; and

(b) in addition, an amount calculated by multiplying Thirty dollars by the number of resident students of Agricola College in that year.

(2.) Where Agricola College, or part of Agricola College, was not in use during the whole of the academic year included in a year to which this section applies, the Minister may determine that the amount payable under this section in respect of that year shall be such part only of the amount that would otherwise be payable as the Minister thinks appropriate.

(3.) The financial assistance to the State of Western Australia under this section is granted on the conditions that—

(a) the State will, in respect of each payment of that financial assistance and without undue delay, pay an amount equal to that payment to the body administering Agricola College; and

(b) the State will ensure that each amount so paid by the State is used, in the year in which it is paid, for the provision of tutorial assistance to students of, or for meeting administrative costs of, Agricola College.

(4.) The Treasurer may, at such times as he thinks fit, make advances of such amounts as he thinks fit to the State of Western Australia on account of an amount that may become payable under this section to the State, and the conditions set out in the last preceding sub-section are applicable to any such advance.

(5.) For the purposes of this section, the number of resident students of Agricola College in a year to which this section applies is the number that is the average of the maximum numbers of such students during the several terms of the academic year included in that year.

(6.) In this section, “year to which this section applies” means each of the years One thousand nine hundred and seventy-one and One thousand nine hundred and seventy-two.

Additional conditions.

7. In addition to the conditions specified in either of the last two preceding sections, an amount of financial assistance to a State under either of those sections is granted on the conditions that—

(a) if the Minister informs the Treasurer of the State that he is satisfied that the State has failed to fulfil the conditions applicable to that amount, the State will repay that amount to the Commonwealth; and

(b) if that amount exceeds the amount properly payable, the State will repay the excess to the Commonwealth.

Appropriation.

8. Payments to a State under section 5 or section 6 of this Act shall be made out of the Consolidated Revenue Fund, which is appropriated accordingly.
