Overview

The Australian National University Staff Superannuation (Repeal) Statute 2014 was enacted to repeal the Staff Superannuation Statute 2007. This legislative instrument was made under the authority of section 50 of the Australian National University Act 1991. The purpose of the Statute is to address the gap created by the transfer of the administrative responsibility for the pensions previously covered by the Staff Superannuation Statute 2007 to UniSuper Ltd. The Australian National University's Council considered and approved the Statute on 3 October 2014, signifying the policy objective of ensuring that the legislative framework aligns with the current administration of the superannuation arrangements.

Scope and Application

The Australian National University Staff Superannuation (Repeal) Statute 2014 serves to repeal the Staff Superannuation Statute 2007, a legislative instrument previously governing the superannuation arrangements for staff of the Australian National University. This repeal is necessitated by the transfer of the administration of these pension arrangements to UniSuper Ltd, which now manages the pensions covered by the repealed statute. The statute applies to the staff of the Australian National University, whose superannuation arrangements were previously governed by the Staff Superannuation Statute 2007. The repeal of this statute reflects a jurisdictional shift within the university, altering the legislative framework that governed their retirement benefits. The repeal is geographically confined to the Commonwealth of Australia, specifically affecting entities and individuals associated with the Australian National University. There are no stated exclusions or exemptions within the statute, and the repeal is straightforward without extensions or restrictions introduced through subordinate instruments. The process of repealing the statute was undertaken with internal approval from the University Council, signifying the legislative and administrative alignment with the current superannuation provider, UniSuper Ltd.

Key Provisions

The Australian National University Staff Superannuation (Repeal) Statute 2014 operates under the authority of the Australian National University Act 1991, section 50 (Section 1). This statute serves to repeal the Staff Superannuation Statute 2007, as the pension arrangements previously governed by the latter are now administered by UniSuper Ltd (Section 2). This repeal signifies that the previous legislation is no longer applicable, as the management of these pensions has been transferred to UniSuper Ltd. Under this statute, the obligations and requirements that were previously imposed on the Australian National University and its staff concerning superannuation are now entirely managed by UniSuper Ltd. The university and its staff are no longer required to adhere to the provisions of the Staff Superannuation Statute 2007. Instead, they must comply with the terms and conditions set by UniSuper Ltd for the administration of these pensions. This shift in administration means that any previous contributions, entitlements, and obligations related to staff superannuation are now governed by UniSuper Ltd's policies and procedures. In terms of legal consequences, the Australian National University Staff Superannuation (Repeal) Statute 2007 does not explicitly outline specific offences, penalties, or consequences for non-compliance. However, any breaches of the terms and conditions set by UniSuper Ltd, which now governs the superannuation arrangements, would be subject to the penalties and consequences outlined in UniSuper Ltd's governing documents and relevant legislation. The repeal itself does not introduce new offences but rather transfers the responsibility and potential consequences associated with non-compliance to the new administering body, UniSuper Ltd. The university and its staff must ensure they comply with the new arrangements to avoid any potential penalties or consequences that may arise from non-compliance with UniSuper Ltd's rules.
