Explanatory Statement
Statutory Rules 1982 No. 253
Spirits Regulations (Amendment)
Issued by the Authority of the Minister for the Capital Territory for and on behalf of the Minister for Industry and Commerce
The purpose of the accompanying regulations is to amend in two respects the Spirits Regulations to increase from $10.47 to $16.75 per hour or part thereof, the charge prescribed in regulations 30 and 42 of the Spirits Regulations for the services of an officer.
Regulation 30 of the Spirits Regulations imposes this charge when the services of an officer are necessary to supervise wholly or partially the manufacture of any product in which methylated spirits is used.
Regulation 42 of the Spirits Regulations imposes this charge when the quantity of methylated spirits to be made is such as to require, in the opinion of the Collector, the services of a special officer.
The increase in these charges is made as a consequence of a review made of costs for Customs inspection out-of-hours and away from designated clearance areas. The review was aimed at finding ways of recouping the costs incurred in providing the services of officers in these cases.
Following that review a common charge of $16.75 will apply to all recoveries.
Overview
The Spirits Regulations (Amendment) Statutory Rules 1982 No. 253, issued by the Authority of the Minister for the Capital Territory on behalf of the Minister for Industry and Commerce, was enacted to address the issue of adjusting the charges for the services of officers required for the supervision of products involving methylated spirits. This amendment was prompted by a review of the costs associated with customs inspections conducted outside of regular hours and away from designated clearance areas. The policy objective behind this change was to establish a uniform charge of $16.75 per hour or part thereof, replacing the previous rate of $10.47, to better reflect the actual costs incurred during such inspections and ensure the recovery of these expenses.
This legislative adjustment was intended to ensure that the costs associated with providing the necessary supervisory services for products involving methylated spirits are accurately accounted for and compensated. By implementing this change, the government aimed to maintain the efficiency and effectiveness of customs inspections while ensuring that the financial burden on the relevant authorities is appropriately managed.
Scope and Application
The Spirits Regulations (Amendment) Statutory Rules 1982 No. 253 applies to any entity or individual engaged in the manufacture of products using methylated spirits within the jurisdiction of the Australian Capital Territory. Specifically, the regulations pertain to the charge for the services of an officer who supervises the manufacture of such products. This amendment updates the previously set charge of $10.47 to $16.75 per hour or part thereof, as stipulated in Regulations 30 and 42 of the Spirits Regulations. This change is applicable when an officer’s supervision is required for the manufacture of products involving methylated spirits, or when the quantity of methylated spirits being produced necessitates the services of a special officer. The amendment extends to all instances where the manufacture occurs out-of-hours or outside designated clearance areas, reflecting a uniform charge of $16.75 as determined by a review of the costs associated with Customs inspection services in these circumstances.
Key Provisions
The Spirits Regulations (Amendment) Statutory Rules 1982 No. 253, issued under the authority of the Minister for the Capital Territory and on behalf of the Minister for Industry and Commerce, primarily amend the Spirits Regulations to increase the charge for the services of an officer from $10.47 to $16.75 per hour or part thereof. This amendment affects two specific regulations: regulation 30, which concerns the supervision of the manufacture of products involving methylated spirits (section 30), and regulation 42, which pertains to the requirement for special officers when the quantity of methylated spirits warrants it (section 42). The new charge of $16.75 per hour is a unified rate established following a review of out-of-hours and off-site Customs inspection costs.
The revised regulations impose obligations on manufacturers and relevant authorities to ensure compliance with the new charge structure. Specifically, when an officer's services are required to supervise the manufacture of products using methylated spirits, or when the quantity of methylated spirits necessitates the involvement of a special officer, the amended charge of $16.75 per hour must be paid (sections 30 and 42). These obligations are intended to ensure that the costs of providing such services are appropriately recovered, reflecting the true expense of out-of-hours and off-site inspections.
Failure to comply with the new charge structure could result in legal consequences. Although the specific offences, penalties, or civil and criminal consequences for non-compliance are not detailed in the explanatory statement, it is implied that any breach of the amended regulations could lead to enforcement actions. Typically, such breaches could attract fines or other penalties as prescribed by relevant legislation, ensuring that the costs associated with these services are adequately covered. The precise penalties would be in accordance with the broader legal framework governing Spirits Regulations and the enforcement mechanisms provided therein.
