Overview
The Special Annuity Act 1935 was enacted to address the need for a financial provision for the widow of the late Senator the Honourable Sir Walter Kingsmill. Enacted by the Parliament of the Commonwealth of Australia, the Act establishes an annuity payable to Sir Walter Kingsmill's widow at a rate of one hundred and fifty-six pounds per annum from the Consolidated Revenue Fund. This Act arose from a grant originated in the House of Representatives, signifying a legislative intent to honour the service and contributions of Sir Walter Kingsmill through financial support for his widow. The policy objective is to ensure that the widow receives ongoing financial assistance, which ceases upon her remarriage.
Scope and Application
The Special Annuity Act 1935 applies to the specific circumstance of providing a financial annuity to the widow of the late Senator the Honourable Sir Walter Kingsmill. This Act is a Commonwealth legislation, binding within the legal framework of the Australian nation. It designates a specific annual payment from the Consolidated Revenue Fund, directed towards the beneficiary mentioned. The Act is limited to the singular purpose of providing financial support to the widow and does not extend to any other individuals or entities, nor does it cover any other types of conduct, transactions, or industries. The geographic reach of the Act is national, applicable across the entirety of the Commonwealth of Australia. There are no stated exclusions, exemptions, or thresholds within the Act itself, although the payment ceases if the beneficiary remarries. The Act does not extend or restrict its application through subordinate instruments as there are no subordinate instruments associated with this Act.
Key Provisions
The Special Annuity Act 1935 (hereafter referred to as the Act) establishes the payment of an annuity to the widow of the late Senator the Honourable Sir Walter Kingsmill. Section 1 specifies the short title of the Act, while Section 2 outlines the annuity's details. Specifically, Section 2(1) mandates that an annuity of one hundred and fifty-six pounds per annum is to be paid to the widow from the Consolidated Revenue Fund. This annuity is a specific provision made to provide financial support to the widow of the late Senator.
The Act imposes several obligations on the government and entities involved in the payment of the annuity. Section 2(1) requires the government to ensure that the annuity is paid regularly and as specified. Section 2(2) stipulates that the annuity payment will cease if the annuitant remarries, indicating a condition under which the annuity stops.
The Act also sets out consequences for non-compliance with its provisions. Although the Act does not explicitly detail penalties for breach, the cessation of annuity payments upon remarriage, as stated in Section 2(2), serves as a significant consequence. Non-compliance with the condition of remarriage would mean that the widow would no longer receive the annuity, thus impacting her financial situation. While specific penalties are not outlined in the Act, the clear stipulation of annuity cessation upon remarriage implies a strict adherence to the conditions set forth.
