Overview

The South Australia Class 3 Long Prime Mover Combination Exemption Notice 2023 (No.1) was enacted to provide exemptions from certain dimension requirements for class 3 heavy combinations in South Australia. This notice was introduced to streamline the operation of heavy vehicles, particularly prime movers towing semitrailers, within specified parameters while maintaining safety and regulatory standards. It was issued under the Heavy Vehicle National Law (HVNL), specifically section 117, which grants the Regulator the power to exempt certain categories of heavy vehicles from compliance with mass or dimension requirements, and section 23 of Schedule 1, which allows for the amendment or repeal of instruments. The notice aims to replace the previous exemption notice from 2018, ensuring updated regulatory compliance and operational flexibility for eligible vehicles. The notice came into effect on 14 July 2023 and will expire on 13 July 2028, providing a defined period for its operation and evaluation.

Scope and Application

The South Australia Class 3 Long Prime Mover Combination Exemption Notice 2023 (No.1) applies to Class 3 heavy vehicles, specifically those consisting of a prime mover towing a semitrailer, operating within South Australia. This notice provides exemptions from certain mass and dimension requirements under the Heavy Vehicle National Law and the Heavy Vehicle (Mass Dimension and Loading) National Regulation, but only to vehicles that meet the conditions set out in the notice. Notably, this exemption notice revokes and replaces the South Australia Class 3 Long Prime Mover Combination Exemption Notice 2018 (No.1). The exemption applies to eligible vehicles that comply with the notice's specific conditions, including a maximum length of 20.0m and adherence to road, travel, and vehicle conditions as per the Heavy Vehicle National Law. The notice comes into effect on 14 July 2023 and will expire on 13 July 2028.

Key Provisions

The South Australia Class 3 Long Prime Mover Combination Exemption Notice 2023 (No.1) primarily exempts eligible vehicles from certain mass and dimension requirements under the Heavy Vehicle National Law (HVNL). Specifically, it exempts class 3 heavy combinations consisting of a prime mover towing a semitrailer from the prescribed mass requirements (section 8). This exemption is conditional, applying only if the vehicle adheres to specific dimension limits stipulated in the notice, such as not exceeding 20.0m in length (section 9). Eligible vehicles must comply with these conditions to benefit from the exemption. The notice imposes several obligations on the parties it governs. Eligible vehicles must operate within the specified length limit of 20.0m and adhere to the designated network, including the South Australia 26metre B-Double Network (GML) and the 26.0m B-double Commodity network (GML) (sections 9 and 11). Additionally, vehicles must comply with road conditions (section 160), travel conditions (section 161), and vehicle conditions (section 162) as stipulated in the HVNL. These conditions ensure that while the vehicles are exempt from certain dimension requirements, they must still meet other safety and operational standards. Breach of the conditions outlined in the notice can result in various consequences. While the notice does not explicitly state penalties, non-compliance with the HVNL could lead to enforcement actions under the law. This may include fines, vehicle impoundment, or other legal actions as deemed necessary by the Regulator. The exact penalties would depend on the nature and severity of the breach, as outlined in the broader provisions of the HVNL. It is essential for parties governed by this notice to adhere strictly to the conditions to avoid any potential repercussions.
